SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL REGISTERED LAND
SURVEY FOR BRUCE DIGERNESS FOR ED KAPLAN FOR DICO ENTERPRISES, INC. (83014)
WHEREAS, the City Council has approved the Final Registered Land Survey for Bruce
Digerness for Ed Kaplan, for Dico Enterprises, Inc.;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the following to be met, prior to
recording of, and related to said Registered Land Survey:
1. Compliance with the City Engineer's Memorandum.
2. Tracts A, E and F shall be dedicated to the City and County as appropriate,
for right-of-way purposes.
3. There shall be filed as a Notice of Record against the Title of property known
as Tracts B C, and of the proposedRegistered Land Survey, a memorial of the
variance approval in a manner and f rm approved by the City Attorney.
4. The petitioner shall prepare and submit for approval by the City Attorney
prior to filing, appropriate agreements, and cross easements regarding shared
water service; common liability for fire, theft, intrusion and the like, for
the required fire rated separation wall.
5. Execution of an agreement between the petitioner and the City amending
previous agreements and supplemental agreements as recommended by the Director
of Public Works, and as approved as to form and content by the City Attorney.
6. The requirement of Resolution No. 74-220 requiring Tract B of Registered Land
Survey No. 921 be consolidated with neighboring property known as Registerd
Lane Survey No. 1252, is hereby rescinded.

7. The requirement of Resolutic^ No. 73-414, that Tract A Registered Land Survey
No. 942 be consolidated with Tract A Registered Land Survey No: 1376,.1s
hereby rescinded, unless, for whatever reason, the circumstances of the
present petition change to the extent that the property remains under single;
ownership; In that case, the City shall consider the adoption of a Resolution
consolidating the property into a single parcel as required by the City Zoning
Ordinance; with, direction to the CIty Attorney that said Resolution be filed
Immediately upon adoption.
8. A 30 -ft. trail easement should be provided along 13th Avenue North.

Whereupon the Resolution was declared duly passed and adopted.
