The following members were present: Mayor Davenporrr, C17=11 emb pers�'en-MTr Schneider and Threinen The following ZMers were absent., none ata aaa aaa Councilmember Threinen introduced the following Resolution and moved its adoption: RESOLUTION NO. 83- 524 DENYING REVISED RPUD PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR TOMARK DEVELOPMENT COMPANY FOR CAMBRIDGE COURT (RPUD 82-1) (83040) WHEREAS, Tomark Development Company has requested approval of a Revised RPUD Preliminary Plan/Plat and Conditional Use Permit for "Cambridge Court" (RPUD 82-1) for 108 dwelling units on 8.2 acres located located west of Plymouth Creek and north of 37th Avenue North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends denial; NOW, THEREFORE, BE IT HEREBY RESOLVED BY TME CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that It should and hereby denies the Revised RPUD Preliminary Plan/Plat and Conditional Use Permit for Tomark Development Company for "Cambridge Court" (RPUD 82-1) •for 108 dwelling units on 8.2 acres located west of Plymouth Creek and north of 37th Avenue North for the following reasons: 1. The Planned Unit Development Ordinance criteria and attributes have not been satisfied, in that the proposal does not enhance the overall area; does not provide innovative building design; does not establish higher standards of construction; does not provide more efficiency in the utility layout; does not provide adequate recreational amenities; and, does not provide effectve and suitable open space. 2. The site is better suited for an apartment development as contemplated by the approved PUD Plan.
