HomeMy WebLinkAboutCity Council Resolution 1983-520Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on tTie �rT day of October , 19B3, The following members were present: Mayor DavenporT,-tZMilmember-Mffen,--We-T7r, — Schneider and Threinen The following members were absent: none Councilmember Neils introduced the following Resolutiou and moved its adoption: RESOLUTION NO. 83-520 APPROVING VARIANCES FROM THE SUBDIVISION CODE AND URBAN DEVELOPMENT POLICY RESOLUTION NO. 75-664 FOR DOLORES AND ROSAMER MOLL (83036) WHEREAS, Dolores and Rosamer Holl have requested variances from the Subdivision Code and Urban Development Policy No. 75-664 to allow the issuance of two Ruildinq Permits for two parcels, each approximately 20 acres in size, that would not have frontage onto a public road located north and west of the Soo Line Railroad tracks and Holly Lane in the northwest quarter of Section 8; and, WHEREAS, the petitioner proposes to create and convey the two parcels in accordance with State Statutes; and, WHEREAS, the Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE, BE 1T HEREBY RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, should and hereby does approve the variances from the Subdivision Code and Urban Development Policy No. 75-664 for Dolores and Rosamer Moll to permit the issuance of two Building Permits for two parcels, each approximately 20 acres in size, that would not have frontage onto a public road located north and west of the Foo Line Railroad tracecs and Holly Lane in the northwest quarter of Section 8, subject to the following co,iditions: 1. Compliance with the City Engineer's Memorandum. 2. No yard setback variances are granted or implied. 3. Compliance with Policy Resolution No. 74-80 regarding minimum floor elevations for new structures on sites adjacent to or containing open storm water drainagf facilities. 4. Payment of park dedication fees-in-lleu of dedication prior to Issuance of Building Permit in accordance with City Policy in effect at the time of Building Permit issuance. Future development of the property shall comply with the Comprehensive Trail Plan and Park Dedication Policy. 5. Appropriate documents shall be filed on all parcels indicating that in conjunction with this division, conceptual development plans have been placed on file with the City for future reference. PLEASE SEE PACE TWO Page two Resolution No. 83- 520 b. Submittal of all necessary utility easements prior to Issuance of building permits. 7. Appropriate perpetual access easements, as approved by the City Attorney, providing for access across the respective properties shall be filed and recorded prior to issuance of any Building Permits. 8. No more than one Building Permit shall be issued until evidence is submitted verifying the existing parcel has been divided by the County.
