The following aeobers were present: in r hne de n rs n Neils and i e follow n Thg m@m5ers were 115senz: Davenport Councilmember Moen introduced the following Resolution and moved Its adoption: RESOLUTION NO. 83- 506 REQUEST FOR PAYMENT NO. 1 AND FINAL 1983 SEAL COAT PP.OGRA!' WHEREAS, the City of Plymouth as Owner and Allied Blacktop, Inc., Minneapolis Minnesota have entered into an agreement for the seal coating of certain streets, said agreement being dated June 28, 1983; WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THERZFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $179,913.30 and the value of the work completed to date is $188,107.30. 2. That the work performed by the Contractor for the 1983 Seat Coating Program and certified to the Council by the Engineer as acceptable be and the same is hereby accepted as of September 19,1983. The Contractor is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the owner, required guarantees and Correction of Faulty Work after Final Payment. 3. Request for Payment No. 1 and Firil in the amount of $188,107.30 to Allied Blacktop, Inc. for improvement is heryby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith from fund 101-172-810. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils andupon vote t" taken thereon the 0 owing votedn favor thereof: Acting Mayor Schnei9der, Councilmem6ers Moen, Neils and Threinen The following vote against -or abstained: none Whereupon the Resolution was declared duly passed and adopted.
