Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held oo tTie -ltn day of September 19-u.

Councilmember Moen Introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 83- 498
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR 7ACHARY
HILLS 3RD ADDITION FOR MARVIN H. ANDERSON CONSTRUCTION COMPANY (79045)
WHEREAS, the City Council has approved the Final Plat and Development Contract for
Zachary Hills 3rd Addition as requested by Marvin H. Anderson Construction Company;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the following to be met, prior to
recording ^`, and related to said plat:
1;. Compliance with the City Engineer's Memorandum.
i2. Compliance with applicable provisions for Final RPUD Plats in Section 9 of the
Zoning Ordinance including filinq of Homeowner Association documents as
approved by the City Attorney with the Final. Plat.
3. No Building Permits shall be isr;ued until the Final Plat is filed and recorded
at Hennepin County.
4. Payment of park dedication fees -in -lieu of dedication in accordance with City
Policy In effect at the tine of filing the Final Plat or at issuance of
Building Permit.
5 No Building Permits shal.) be Issued until municipal sewer and water are
physically available to thv; sites.
6. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing of the Final Plat.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Threinen , and upon vote being taken thereon the
following voted n favor thereof:Acting Mayor Schneider, Councilmembers Moen, Neils
The following voted against or abstained-. none
Whereupon the Resolution was declared duly passed and adopted.
