The following members were present: Mayor Davenp��nc da ne4dll' and Threinen The follow ng members were absent: Counc Councilmember Schneider introduced the following Resolution and moved its a t on: RESOLUTION NO. 83- 469 APPROVING RPUD FINAL PLAN FOR TOMARK DEVELOPMENT COMPANY FOR "CREEK PLACE OF PLYMOUTH" AND SETTING CONDITIONS TO BE MET PRIOR TO FILING AND REGRDING FINAL PLAT FOR PLYMOUTH HILLS 5TH ADDITION (RPUD h0. 82-1) LOCATED SOUTHEAST OF COUNTY ROAD 9 AND PLYMOUTH BOULEVARD (82013) WHEREAS, Tomark Development Company has requested approval of a RPUD Final Plan and Plat for the second phase construction of "Creek Place of Plymouth" (RPUD 82-1) consisting of 72 condominiums and Final Plat for "Plymouth Hills 5th Addition located southeast of County Road 9 and Plymouth Boulevard; and WHEREAS, the Planning Commission has reviewed said request and recommends its approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request of Tomark Development Company for RPUD Final Plan approval for the second phase of "Creek Place of Plymouth" (RPUD 82-1) consisting of 72 condominium units and Final Plat for "Plymouth Hills 5th Addition" located southeast of County Road 9 and Plymouth Boulevard subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of filing the Final Plat. 3. No Building Permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 4. Removal of all dead or dying trees from the property at the owner's expense. 5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to or containing any open storm water drainage facility. 6. Yard setbacks are per approved plan. 7. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing of the Final Plat. 8. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. Page two Resolution No. 83- 469 9. Appropriate legal documents regardinq Homeowner Association covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat. 10. Submission of required financial guarantee for site improvements not included in the Development Contract and guarantees for "Plymouth Hills 5th Addition". 11. Development of sidewalks in .accordance with the "Downtown Plymouth" Sidewalk Master Plan shall be per plans approved by the City Engineer, as set forth in the Development Contract for "Plymouth Hills 5th Addition". 12. No Building Permits shall be issued for Phase II until the trail/bridge Improvements as defined in Item 13.2 of the "Plymouth Hills 4th Addition" Development Contract are completed and approved by the City Fngineer. 13. Fire lane width at the curves shall be 14 ft. wide and/or maintain a 40 ft. radius. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Moen , and upon vote being taken thereon, te following vo n favor thereof: Councilmembers Moen, Schneider and Threinen Ine TOliOwing voted against or abstained: Ka or oven Whereupon the Resolution was declared duly passed and adopted. dsk2B
