HomeMy WebLinkAboutCity Council Resolution 1983-464o ncilmemher Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 83-464 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN, PRELIMINARY PLAT, AND CONDITIONAL USE PERMIT FOR LUNDGREN BROTHERS CONSTRUCTION COMPANY FOR THE CITY OF MINNEAPOLIS FOR PARKERS LAKE DEVELOPMENT - THE VICKSBURG WEST PROPERTY (82066) WHEREAS, Lundgren Brothers Construction Company for the City of Minneapolis has re- quested approval of a Residential Planned Unit Development Plan Preliminary Plat, Con- ditional Use Permit and Rezoning for Parkers Lake Development - The Vicksburg west Property, for 376 dwelling units on approximately 158 acres located between nunkirk Lane and Vicksburg Lane in the Northeast Quarter of Section 2.9; and, WHEREAS, the Planning Commission has reviewed the request at a duly called public hear- ing and recommends approval; and, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Residential Planned Unit Development Plan Preliminary Plat and Conditional Use Permit for Lundgren Brothers Construction Company for the City of Minneapolis for Parkers Lake Development - The Vicksburg West Property located between Dunkirk Lane and Vicksburg Lane in the Northeast Ouarter of Section 29 subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be Issued until a contract has been awarded for sewer and water. 4. Satisfaction of park dedication policy requirements, with appropriate credits In an amount determined according to verified acreage and paving costs, ac- cording to the Dedication Policy In effect at the time of filing the Final Plat and in accordance with the agreement approved under Resolution No. 83-292. 5. Street names shall comply with the City Street Naming System to be determined with the Final Plat. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to or containing any open storm water drainage facility. 7. Rezoning for this stage shall be finalized with filing of the Initial Final Plat for this stage. 8. Completion of the Environmental Assessment Worksheet (EAW) review process prior to submission of a Final Plat application. I y`% IR75-M n Resolution No. 83- 464 9, No Building Permits shall be .issued until the initial Final Plat for this stage is filed and recorded with Hennepin County. 10. Yard setbacks shall be per approved final plan; the minimum front yard setback shall be 25 ft for the following lots in Living Area A: Lots 1-8, 13-15, 22- 26, 28-31, and 33-34 in Block 2 per the Preliminary Plat. 11. Appropriate legal documents regarding Homeowner Association covenants, bylaws, and restrictions as required by Ordinance and approvals and as approved by the City Attorney, shall be filed with the Final Plat. 12. Compliance with the terms of the agreement as stated in Resolution No. 83-134/ /83-292. 13. Staging of the development shall be in accordance with utility availability as approved by the City Engineer. 14. Should development on the property west of Vicksburq Lane precede the upgrad- ing of Dunkirk Lane, which is contemplated by the Capital Improvements Program (CIP), the developers shall construct on-site pondinq to retain all additional surface water runoff on this site at their expense. 15. The developer will provide copies of the overall PUD Plan and its conditions as an addendum to their purchase agreements. 16. Development of Stage 8: The Parkers Lake North Property - Parkers Lake MPUD shall comply with Resolution No. 83-134/83-292 and the preliminary plat/plan application shall respond to the conditions stated in Resolution No. R3-134/ 83-292. 17. The approved number of dwelling units for this stage is 376 which is within the density range for this stage. 18. Property owners in Living Area C shall own the designated open spare within this development area, and the provisions for maintenance of the open space shall be defined by the developer within the Homeowner's Association docu- ments, which shall also provide that residents of Living Area D-1 shall have access to, and use of, this open space. 19. All single family dwellings in Stage A shall have attached garages. 20. No Building Permits shall be issued beyond the connection of 24th Avenue and Yana Lane, until Yuma Lane is connected to Vicksburg Lane, or to Dunkirk Lane via a route other than 24th Avenue. 21. The petitioner and City staff shall develop some mechanism to insure the designation and saving of significant trees in Living Area A. This provision shall be included in the Development Contract and shall include financial penalties.
