The following members were presentsMayar Davenport—, i 1membe , and Schneider The following rs were sent: CouncilmlMer Threinen Councilmember Moen introduced the following Resolution and moved its adoption: APPROVING SITE PLAN AND CONDITIONAL USE PERMIT AMENDMENT AND VARIANCF FOR WILIAM GADTKE (83032) RESOLUTION NO. 83-418 WHEREAS, William Gadtke has requested approval for a Site Plan and Conditional Use Per- mit Amendment and Variance to expand an existing self-service carwash located at 3500 Kilmer Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear- ing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Site Plan and Conditional Use Permit Amendment and Variance for William Gadtke for the expansion of an existing self-service carwash located at 3510 Kilmer Lane subject to the following: 1. Compliance with the City Engineer's Memorandum, with submittal of required drainage plans and easements prior to issuance of a Building Permit. 2. Submission of required Site Improvement Performance Agreement and the required financial guarantees for completion of site improvements. 3. All waste and waste containers shall be stored within the approved structure and no outside storage is permitted. 4. The permit is subject to all applicable codes, regulations and Ordinances and violation thereof shall be grounds for revocation. 5. The permit is issued to the petitioner as operator of the facility acid shall not be transferable. 6. The site shall be maintained in a sanitary manner. 3. There shall be no outside display, sales, or storage of merchandise or related materials. 8. The permit shall be renewed in one year to assure compliance with the conditions. 9. Variances, in addition to those previously approved for this site, are approved for: side yard setback for parking of 5 feet rather than 20 feet.
