Councilmember Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 83- 417
APPROVING RPUD CONDITIONAL USE PERMIT AMENDMENT, SITE PLAN, AND CONDITIONS TO BE MET
PRIOR TO AND REGARDING FILING FINAL PLAT FOR RICHARD ZFJDLIK, RATON CORPORATION FOR
MISSION WEST (RPUD 76-1) (A-338)
WHEREAS, Richard Zejdlik, Baton Corporation has requested approval. of an RPUD
Conditional Use Permit Amendment, Site Plan and Final Plat for Mission West (RP(1D 76-1)
located south of Goldenrod Lane and County Road 9; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval; and,
WHEREAS, the City Council has approved the Final Plat for Mission West;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the RPUD Conditional Use Permit
Amendment, Site Plan and the conditions to be met prior to and regarding filing the
Final Plat for Richard Zejdlik, Baton Corporation for Mission West (RPUD 76-1) located
south of Goldenrod Lane and County Road 9 subject to the following:
1. Compliance with the City Engineer's Memorandum
2. Submission of required financial guarantee and performance aqreement for
completion of site improvements.
3. Signage shall be in compliance with the approved Sign Plan.
4. All waste and waste containers shall be stored and screened within an approved
structure and no outside storage is permitted.
5. Payment of park dedication fees -in -lieu of dedication in accordance with City
Policy in effect at the time of filing the Final Plat.
6. No Building Permits shall be issued until a Contract has been awarded for the
construction of municipal sewer and water.
7. Removal of all dead or dying trees from the property at the owner's expense.

8. Yard setbacks shall be In accordance with the approved plan; including
underground garage encroachment into setback area from County Road 9 for
Buildings 'A' and 'B'.
9. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
10. No Building Permits to be issued until the Final Plat Is filed and recorded
with Hennepin County.
11. Appropriate legal documents regarding the Homeowner Association bylaws and
covenants and restrictions and regarding shared access and private circulation
drives per Section 9 of the Zoning Ordinance and as as approved by the City
Attorney, shall be filed with the Final Plat.
12. Access to 41st Avenue North shall be from the access approved with Phase I,
and no occupancy shall be allowed in Phase II until 41st Avenue North is
constructed.
13. The temporary construction access from County Road 9 may be used for
construction vehicles until construction of Phase II is completed, at which
time the temporary construction access shall be eliminated.
14. An interconnection shall be constructed between the projects in the vicinity
of the 10 -ft. utility easement.
