RESOLUTION NO. 83- 412 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT CONCEPT PLAN, PRELIMINARY PLAN/PLAT, AND CONDITIONAL USE PERMIT FOR DENNIS GONYEA FOR GONYEA'S THIRD ADDITION (RPUD 83-3) (83030) WHEREAS, Dennis Gonyea has requested approval of a Residential Planned Unit Development Concept Plan, Preliminary Plan/Plat, and Conditional Use Permit and a waiver from the minimum size requirements for PUD's for Gonyea's Third Addition, consistinq of 44 single family lots on 19.5 acres at the northeast corner of 36th Avenue North and Zachary Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called public hear- ing and recommends approval; and, WHEREAS, the City Council approved a Final Plat for a conventional plat known a!, Gonyea's Third Addition for the easterly portion of this site on April 18, 1983 under 0 - Resolution Nos. 83-206 and 83-207; NA, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that It should and hereby does approve the Residential Planned Unit Development Concept Plan, Preliminary Plan/Plat and Conditional Use Permit for Dennis Gonyea for Gonyea's Third Addition on property located in the northeast corner of 36th Avenue North and Zachary Lane subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying tree:, from the property at the owner's expense. 3. No Building Permits shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filinq the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. No Building Permits shall be issued until the Final Plat for this development Is filed an recorded with Hennepin County. 7. Setbacks shall be per PUD Plan. 8. A waiver from the 40 acre minimum requirement for PUD's is approved on the basis that there are unique constraints and the development is similar in nature to the adjoining developments; and, PLEASE SEE PAGE 2 13. Existing 38th Avenue North shall be barricaded until new 38th Avenue North is completed. FURTHER, Resolutions No. 83-206 and 83-207 are hereby rescinded. A waiver from the Bonus Point provisions to allow a density of 2.2 units per acre is approved on the basis the plan is similar to and compatible with the adjoining developments. 10. Appropriate legal documents regarding Homeowner Association covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat, including ownership and maintenance of Outlot A. 11. Outlot A be shall fenced around the north and west sides of the play area. 12. Allow the retention of only the existing house on lot 13, otherwise all existing structures shall be removed and the site shall be cleared prior to Issuance of Building Permits. 13. Existing 38th Avenue North shall be barricaded until new 38th Avenue North is completed. FURTHER, Resolutions No. 83-206 and 83-207 are hereby rescinded.
