Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was gela on the IS day of

Couneilmember NeilsIntroduced the following Resolution and moved its
adoption
RESOLUTION NO. 83-401
REQUEST FOR PAYMENT NO. 5 AND FINAL
COMMUNITY PLAYFIELD IMPROVEMENTS, PHASE III, SCHEDULE E
PROJECT NO. 017
WHEREAS, the City of Plymouth as owner and Natural Green, Inc. as contractor
have entered Into an agreement for the Community Playfleld Improvements, Phase
111, Schedule E, said agreement being dated July 21, 1981; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $45,865.00, no change
orders were approved, and the value of the work to date is
$45,865.00.
2. That the work performed by the contractor for Project No. 017,
Phase III, Schedule E, and certified to the Council by the eng1-
neer as acceptable be and the same is hereby released from the
contract except as to the conditions of the performance bond,
any and all legal rights of the owner, required guarantees and
corrections of faulty work afer final payment.
3. Request for Payment No. 5 and Final in the amount of $4,471.84
to Natural Green, Inc. for Project 017, Phase III, Schedule E is
hereby approved and the City Finance Director is hereby author-
ized and directed to pay the same forthwith.

Councllmember Moen , and upon vote being taken thereon the
