(83026) WHEREAS, Volp Construction Company has requested approval of Site Plan and Variances for New York Camera and Video, Inc., for a 13,064 sq. ft. office/warehouse facility on property located in the southeast quadrant of the cul-de-sac at 30th Avenue North, east of Ranchview Lane; and, WHEREAS, the Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLtMOUTN, MINNESOTA, that it should and hereby does approve a Site Plan and Variances for Volp Constructic.i Company for New York Camera and Video, Inc., for a 13,064 sq. ft. office/warehouse facility on property located in the southeast quadrant of the 'cul-de-sac at 30th Avenue North, east of Ranchvtew Lane subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with Dedication Policy in effect at the time of Building Permit issuance, with credit for trail paving. 3. Provisions for a 30 -ft. wide trail easement per Comprehensive Park Plan, as verified by the Parks and Engineering Departments, with submittal of detailed plans as to construction of the trail per City standards. 4. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures on sites adjacent to or contairinq any open storm water drainage facility. 5. Submission of required financial guarantee and Site Improvements Performance Agreement for completion of site improvements. 6. Any signage shall be in compliance with the Ordinance. 7. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. PLEASE SEE SECOND PAGE Page two Resolution No. 83- 347 8. All waste and waste containers shall be stored within the structure and no outside storage is permitted. 9. Approved variances include: a) front yard setback (30 ft. vs. 50 ft.) of the building; and, b) from City Code requirements for a fire lane on the south side of the building. 10. That a study be conducted by the City's consulting engineer, to determine whether or not there would be adverse impacts to the north of Highway 55, and that the ponding is adequate, prior to issuance of permits. Volp Construction will pay for the study. The petitioner shall submit an as -built survey of the drainage area prior to issuance of the Certificate of Occupancy for this building. 11. That there will be no retail sales or rentals to the general public conducted from this facility.
