The following members were present: aye o— r aavenport, Coun� cilmem ers oen,-Weils, Schneider and Threinen t�* were absent: none RRR �ouncjlmCmber Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 83- 302 A RESOLUTION APPROVING THE CITY OF PLYMOUTH_ EXECUTING A JOINT AND COOPERATIVE AGREEMENT FOR THE ESTABLISHMENT OF A BASSETT CREEK WATERSHED MANAGEiENT COMMISSION TO PLAN, CONTROL, AND PROVIDE FOR THE DEVELOPMENT OF BASSETT CREEK RRR WHEREAS, the City of Plvmouth 'Minnesota, was one of the original founders and has been a member of the Bassett Creek Flood Control Commission since 1969, and WHEREAS, the City of Plymouth Minnesota, is aware of the need to adopt a surface water management program to preserve and use natural water storage and retention system. to accomplish the following purposes mandated by Minnesota Statutes Section 473.875: (a) to reduce to the greatest practical extent the public capital expenditures necessary to control excessive volumes and rates of runoff, (b) to improve water quality, (c) to prevent flooding and erosion from surface flows, (d) to promote ground water recharge, (e) to protect and enhance fish and wildlife habitat and water recreational facilities, and (f) to secure the other benefits associated with the proper management of surface water, and WHEREAS, the Bassett Creek Flood Control Commission has completed extensive planning activities and is well along in implementing its overall plan to carry out the responsibilities assigned to them by a previous Joint and Cooperative Agreement,and WHEREAS, Minnesota Statutes Section 473.878, Subd. 2, requires that a watershed management orgainization be established on or before December 31, 1983, and it is deemed advisable to continue the work of the Bassett Creek Flood Control Commission, and WHEREAS, a Joint and Cooperative Agreement to carry out these purposes has been prepared after much study and review, NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of Plymouth , Minnesota, as follows: ?aPI 4,Y r k Resolution No. 83-302 Page 2 1. The Mayor and City Plymouth are hereby authorized and directed to execute on behalf of the—City of Plymouth Minnesota, the attached Joint and Cooperative Agreement for the est ablishment of a Bassett Creek Watershed Management Commission to plan, control, and provide for the development of Bassett Creek. 2. The City Clerk is hereby directed to file a certified copy of this resolution with the City Manager of the City of Golden Valley and to carry out any and all other responsibilities necessary to adopt the Joint Powers Agreement and make it a legally binding contract with the other eight municipalities in the watershed for the management of Bassett Creek. The approval of the agreement attached as Exhibit A is conditioned upon the approval of the same document by the other eight municipalities which are presently partially or entirely within the Bassett Creek watershed. The motion for the adoption of the foregoing Resolution was duly seconded by Councilnember Moen , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilr�eriders Moen Neils, Schneider and Threinen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and allopted.
