HomeMy WebLinkAboutCity Council Resolution 1983-265Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the day of�M 1983. The following members were present:Mayor Davenport, Counci]members—Moen,me`iT�s�__ nen ]he follow" members were absent: none Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 93- 265 APPROVING SITE PLAN AND VARIANCES FOR JERRY STONE, STONE MASONRY FOR ROGER HFINE (93011) WHEREAS, Jerry Stone, Stone Masonry has requested approval of a Site Plan and Variances for Roger Heine to construct an office building to he located at 3415 Kilmer Lane; and, WHEREAS, the Planning Commission has reviewed said request and recommends approval; and, NOW, THEREFORE. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that, it should and hereby does approve the request of Jerry Stone, Stone Mason- ry for a Site Plan and Variances for Roger Heine to construct an office buildina to be located at 3415 Kilmer Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with Dedi- cation Policy in effrct at the time of Building Permit issuance. 3. Submission of required financial performance ouarantee for completion of site Improvements. 4. Any signage shall be in compliance with the Ordinance. 5. Approval includes construction of a portion of the parking based upon the pro- pos(,' buldinq useaqu, the "future parking" plan would not he installed until suet. `ime a need fv- -,uch parking is demonstrated. 6. All waste and waste containers shall be stored with the structure and no out- side storage is permitted. 7. Approved variances include: a) an entrance drive width of 20 ft. vs. ?4 ft; b) a 15 ft. building rear yard setback vs 75 ft. Ordinance requirement; c) a 6.5 ft. setback vs. 20 ft. Ordinance requirement for the Proof-of-Parkinq Plan. When the curb cut entrance is reconstructed, It shall he constructed to the 24 -ft. width per Ordinance: standards. 8. There shall be no retail sales on the premises without a Conditional Ilse Permit. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Threinen , and upon vote being taken thereon, the following vote n favor t ereo ayor avenport, Councilmembers Moen, Neils, Schneider and Threinen e following voted against or a s none /hereupon the Resolution was declared duly passed and adopted. dsk2B
