The following members were present: Mayor OavenporT7-r54_ M1 iffi&bel5, Moen, N-el'js, Sc i er and Threi nen -"'�-�—'�"'�"�`y"' The following members were sent: none ~� Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO 83-261 SETTING CONDITIONS TO BE MET PRIOR TO AND REGARDING FILING OF LOT DIVISION AND VARIANCES FOR ROBERT LEUPKE (83012) WHEREAS, the City Council has approved Lot Division and Variances for Robert Leupke for an existing platted lot located west of Dunkirk Lane between lith and 13th Avenues North, Lot 3, Block 1, CITY VIEW ACRES under Resolution No. 83-260 NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does direct the followinq conditions to he met prior to filing of said Lot Division and Variances and issuance of permits: 1. Compliance with the City Engineer's Memorandum. 2. No yard setback variances are granted or implied. 3. Compliance with Policy Resolution No. 79-80 regardinq minimum floor elevations for new structures on sites adjacent to or containing open storm water drainage facilities. 4. Payment of Park Dedication fees -in -lieu of dedication prior to filinq of Lot Division in accordance with City Policy in effect at the time of filing. 5. No Building Permit to be issued until the Lot Division/Variances are filed with Hennepin County. 6. Submittal of all necessary utility easements prior to filing Lot Division/Variances with Hennepin County. 7. Removal of accessory structures at owner's expense prior to issuance of Building Permits; the northeast shed shall be removed from the site prior to issuance of a Building Permit and the southwest shed shall be relocated to comply with the Ordinance minimum setbacks. The motion for adoption of the foregoing Resolution was duly seconded by n ilmember Moen �, and upon vote being taken thereon, the following votedn avor t ereo ayor avenport, Councilmembers Moen, Neils, Schneider and Threinen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adop dsk2B
