Rells.Ublaeld— and Thraingn e following members were sent: ;.,one off Cgiinrilmanber inen introduced the following Resolution and moved Its adoption: RESOLUTION NO. 83-229 SETTING CONDITIONS TO BE MET PRIOR TO FIL'NG AND REGARDING FINAL PLAT FOR "ROBERT MIDDLEMIST 6TH ADDITION" FOR ROBERT MIDDLEMIb1 (81041) WHEREAS, the City Council has approved the Final Plat and Development Contract for "Robert Middlemist 6th Addition" as requested by Robert Middlemist; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does direct the followingto be met prior to recording and regarding said plat: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. Removal of all existing structures and accessory uses from the property at the owner's expense. 4. No building setback variances are Granted or implied other than the common property line. 5. No private drive access onto existing County Road 9 or proposed County Road 9. 6. Rezoning shall be finalized with the filing of the Final Plat. 7. No Building Permits shall be issued until municipal sewer and water are physically available to the site. 8. Required Site Improvements Performance Guarantee shall be submitted prior to issuance of Building Permits. 9. Payment of Park Dedication fees -in -lieu of dedication in accordance with the current Park Dedication Policy in effect at the time of filing the Final Plat. 10. No Building Permit shall be issued until the Final Plat has been filed and reeordeJ with Hennepin County. Page two Resolution No. 83- 229 10 11. Extension of 43rd Avenue North shall be addressed in the Final Plat and Development Contract. 12. Appropriate restrictive covenants as approved by the City Attorney shall be filed prior to issuance of permits. 13. An appropriate barrier to be designed and installed by Hennepin County and City staff between 43rd Avenue North and County Road 9 to restrict traffic crossover between these two streets.
