Schneider f� f ��w —rnia0rj1mAmhAr Moen Introduced the following Resolution and moved its a t on: RESOLUTION NO. 83-184 ADOPTING ASSESSMENT BITUMINOUS STREET - OXBOW RIDGE ADDITION PROJECT NO. 317 WHEREAS, we have received a waiver of assessment hearing from the property owner of Oxbow Ridge Addition waiving their right to special assessment hearings covering the installation of a bituminous street and all other appurtenances; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land herein included is hereby bound to be benefited by the proposed improvement in the amount of 10 the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 5 years, the first of the installments to be payable on or before the first Monday in January 1984 and shall bear interest at the rate of 8% per annum from the date of adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1984. To each subsequent Installment when due shall be added interest of one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certifica- tion of the assessment to the County Finance Director, pay the whole of the assessment on such property with interest accrued to the date of payment to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty days from the adoption of this resolution; and he may, at any time thereafter, pay to the City Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which the payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 1b 5. The total cost of the improvement, including interest, assessed by this resolution is $15,046.41. Resolution No. 83-184 Page 2 6. These assessments were previously deferred by Resolution 80-727, Project 801, P.I.D. 8-118-22-44-0001 In the amount of $22,242..50. A portion of this property has now been platted into building lots and that portion will be assessed ($12,538.69). The portion platted as an outlot will continue to be deferred for the years remaining as specified in Res 80-727 ($9,703.81). The motion for the adoption of the foregoing Resolution was duly seconded by CoUncilmember Neils , and upon vote being taken thereon, the following vot n favor th-e-r-e-eM., Mayor Davenport.
