Pursuant to due call and notice thereof, a 5DeC1_&l� meeting of the City Council of

adoption:
RESOLUTION NO. 83-171
SETTING CONDITIONS TO BE MET PRIOR TO FILING AND REGARDING FINAL PLAT FOR "AMHURST
FIFTH ADDITION" FOR HANS HAGEN HOMES INC. (A-745)
WHEREAS, the City Council has approved the Final Plat and Development Contract for.
"Amhurst Fifth Addition" as requested by Hans Hagen Homes Inc.
NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does direct the following to be met prior to
recording and regarding said plat:
1. Compliance with City Engineer's Memoran am.
2. Park Dedication requirements for 278 units were satisfied as part of the
"Amhurst Second Addition" Development Contract. With the "Amhurst Fifth
Addition", 172 units have been platted. Therefore the Park Dedication
requirements for the "Amhurst Fifth Addition" have been satisfied.
3. No Building Perr "s shall be issued until a Contract has been awarded for the
construction of municipal sewer and water.
4. No Building Permits shall be issued until the Final Plat is filed and recored
with Hennepin County.
5. The Final Plat mylars shall contain a statement referring that the plat is
part of the approved RPUD 79-2 per Section 9 of the 7oninq Ordinance.
6. The yard setbacks shall be per the approved RPUD Plan notinc that Lots 1, 14,
15, and 25, Block 1, shall provide 1 2.0 ft. yard setback to 46th Avenue
North. No private drive access to 46th Avenue North is permitted.
