Cclunci lmembers oen, Nells lihrginen 'ne following members s were bsent : Counci ImemDer S �f• C_uncllmember Moen introduced the following Resolution and moved Its adoption: RESOLUTION NO. 83- 162 APPROVING RESIDENTIAL PLANNED UNLT DEVELOPMENT PRELIMINARY PLAN/PLAT, CONDITIONAL IISF PERMIT, AND REGARDING REZONING FOR "SILVFRIHORNF" FOR GAPY LAURFMT (RPIID 83-?) (8?05?) WHEREAS, Gary Laurent, Laurent Development, has requested approval of a Residential Planned Unit Development Preliminary Plan/Plat, and Conditional Use Permit, and Rezoning for 103 acres to consist of 56 single family residential units and 49 single family attached units and 3 outlots located northeast of 47th Avenue North and Vicksburg Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for "Sllverthorne" for Gary Laurent on property located northeast of 47th Avenue North and Vickshuro Lane, subject to the following conditions: 1. Compliance with the City Fngineer's Memorandum. 2. The Ordinance rezoning the property south of Hamel Road shall be published upon evidence that. the Final Plat has been filed and recorded with Hennepin County. 3. Provisions for a 30 -ft. wide trail easement/outlot per the Comprehensive Park Plan, as -rifled by the Parks and Fnalneerinq Departments, with 54111mlttai of detailed p.ld, s as to construction of the trail per City standards. 4. Payment of Park Dedicdtlon fees -In -lieu of dedication, with appropriate credits In an amount determined according to verified acreage and paving costs, and according to the Dedication Policy in effect at the time of filinn the Final Plat. 5. No Building Permits shali be issued until the City has awarded a Contract for the construction of municipal sewer and water. dsk2A 8. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to or containing any open storm water drainage facility. 9. No yard setback variances are granted or Implied. Setbacks shall he per approved lot layout. 10. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 11. Appropriate legal documents regardina Homeowner Association convenants and restrictions as approved by the City Attorney, and shall he filed with the Final Plat. 12. The information for an Environmental Assessment Worksheet (FAW) shall he completed and the Environmental Quality Hoard EAW procedures shall he initiated upon City Council approval of the Preliminary Plat/Plan. 13. Staging of the development shall be in accordance with utility availability as approved by the City Engineer. 14. Final density shall be 2.5 units per acre for the land at or above the established High Water Ftevatton per the adopted City Storm Water nralnane Plan as verified by the City Engineer. Density honus points are assloned as follows: a. Four points based on the sire of the project; b. One point based on the proposal providlnq a variety of housing types. 15. The land located north of future Hamel Road/Metropolltan urban Service Area (MIJSA) boundary In the Rural Service Area shall not develop until urban services are available; and shall be platted as an outlot. 16. All trail corridors shall be platted as outlots to be deeded to the "Ity. 17. Final Plan/Plat application shall Include construction details for the type and number.of equipment for the tot lot/play area. 18. Outlot F of the Amhurst Development shall be final platted prior to or concurrently with the "Sllverthorne" Final Plat. Such plat shall he filed and recorded with Hennepin County prior to or concurrently with the "Sllverthorne" Plat. 20. All streets which dead-end between phases or at a boundary of the Pili! shall be provided temporary cul-de-sacs, except 47th Avenue west of (Orchid Lane In phase one. 21. The Planning Commission shall review the final oradino and landscapinn plans submitted with Final Plat, relative to the attached housing area and to the external and internal transition of the project.
