HomeMy WebLinkAboutCity Council Resolution 1983-135a CITY OF PUNDUTH Pursuant to due call and notice thereof, a rtnpriil weetinq of the City Council of the City of Plymouth, Minnesota, was held on the- day of_ MArch 193 The following members were present:_ MwQr ,Dave__rt nci lmemb�er�s, R 1 s�.,.� The following rs were absent: none t� Introduced the following Resolution and moved its adoption: RESOLUTION NO. 83-135 APPROVING VARIANCE FOR STEPHEN AND CAROLYN RUFF FOR PROPERTY LOCATED AT 125 BLACK OAKS LANE (P.I.N. 32-118-22-43-0007) WHEREAS, Stephen and Carolyn Ruff, 4829 10th Avenue South, Minneapolis, have requested a Variance to the Ordinance minimum setbacks from recreational development waters to construct a dwelling at 125 Black Oaks Lane; and, WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed said request and recommended denial; and, WHEREAS, the petitioner in accordance with the City Zoning Ordinance has submitted an appeal of the Board's finding in a letter dated February 17, 1983; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the variance to the Shorelands Management Overlay District setback requirements for the purpose of constructing a dwelling at 125 Black Oaks Lane, subject to the followinq: 1. The setbacks shall be no closer to the shoreline than 62 feet as measured horizontally on the survey prepared by Clark Engineerine Company, dated August 6, 1982. 2. That proper erosion control be provided between the construction site and water's edge in keepinq with the City's erosion and siltation policy as out- lined in Resolution No. 81-276. 3. That any further expansion of the dwelllnq or other unattached construction, beyond that shown on the survey and site plan shall be subject to Ordinance requirements. 4. Any boathouse, pier, stairs, or docks shall be subject to the issuance of a Conditional Use Permit provided by the Zoning Ordinance. FURTHER, that the variance is granted based upon the finding that: All six Ordinance Criteria for a variance have been met.
