APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT CONCEPT PLAN AND LAND USE GUIDE PLAN
AMENDMENT FOR CHARLES BELGARDE FOR FERNBROOK CONSTRUCTION COMPANY (82049)
WHEREAS, Charles Belgarde has requested approval of a Residential Planned Unit
Development and Land Use Guide Plan Amendment for Fernbrook Construction Company for
approximately 76.7 acres which are classified as Public/Semi-Public (61.1 acres) and
LA -4 (15.6 acres) located west of Fernbrook Lane and along proposed 34th Avenue North
northeasterly of the City Center; and,
WHEREAS, the Planning Commission has considered the request following a duly scheduled
public hearing;
NOW, THEREFORE, BE 1T,HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the Residential Planned Unit
Development Concept Plan and the Land Use Guide Plan Amendment that reclassifies the
approximately 76.7 acres to 30.7 acres Public/Semi-Public, 9 acres LA -1, 13 acres LA -3,
and 24 acres LA -4 located west of Fernbrook Lane along proposed 34th Avenue North
northeasterly of the City Center, subject to the following:
1. The reguiding is based upon the findings that the proposed classifications are
consistent with the Comprehensive Plan criteria; the City is not prepared to
acquire the entire property now classified Public/Semi-Public; the park needs
addressed in the Comprehensive Plan can be met with the proposed area; and,
the proposed classifications represent the highest and best use for this
property.
2. Approval of the Land Use Guide Plan Amendment is contingent upon and subject
to the required review and response by the Metropolitan Council, and the
Preliminary Plan/Plat which shall be approved by the City Council prior to
finalization of the Amendment.
3. Compliance with the City Engineer's Memorandum.
4. The information for an Environmental Assessment Worksheet (EAW) shall he
submitted as part of the PUD Preliminary Plan/Plat application; the
Environmental Quality Board EAW procedures shall be initiated upon City
Council approval of the Preliminary Plat/Plan.
5. Staging of the development shall be in accordance with utility availability as
approved by the City Engineer, and agreement as to the costs to be assessed to
the development.

6. Maximum overall density shall be 7.9 units per acre for the land at or above

Plan as verified by the City Engineer. Six density bonus points are assigned
as follows:
a. Three points are based on the size of the project;
b. One point based on the proposal providing a variety of housing types;
and;
c. Two pointed based on the provisions for effective open space.
7. The PUD Preliminary Plan/Plat shall respond to the applicable Special
Protection District regulations.
8. Detailed boundaries of proposed public park and open space shall he
finalizedwith the preliminary plan/plat.
9. The construction of 34th Avenue North between the west property line and
Fernbrook Lane is to be completed with the first phase of the development.
10. A minimum of one underground parking space shall be provided for each dwelling
unit In both LA -3 and LA -4 guided areas, as partial satisfaction of Ordinance
minimum parking requirements.
11. All plats, plans, and development agreements are to conform with this concept
plan, and any amendments shall require specific approval of the City Council.
12. Niagara Lane is not to be extended to the north, but shall be looped, perhaps
to Minnesota Lane, subject to preliminary plat and plan review.
13. A maximum effort of buffering and berming shall be provided near Lanewood Lane
from the LA -3 area.
14. All multiple dwelling units to be condominium -type for sale and not for
rental.
