C>(TY.1:011F 'P TH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota. was held on the 14thday of Mauch 19 83 The following members were present: Mayor Davenport, Councilmembers! end` ,-ReiTs, Schneider and Threinen The following members were absent: none Councilmember Moen introduced the following Resolution and moved its adoption; RESOLUTION NO. 83 -126 RESOLUTION CALLING FOk PUBLIC HEARING PURSUANT TO MINNESOTA STATUTES, SECTION 474.01, SUBDIVISION 1b, AND PUBLICATION OF NOTICE WHEREAS, a proposal has been made to the City Council (the "Council") of the City of Plymouth, Minnesota (the "City"), by Gary R. Bluen (the "Borrower"), to undertake a project (the "Project") pursuant to the Minnesota Municipal Industrial Development Act, Minnesota Statutes, Chapter 474 (the "Act"); and WHEREAS, the Project consists of construction of a new office and light manufacturing facility to be located at 2500 Niagra Lane in the City; and WHEREAS, Section 474.01, Subdivision 7b, of the Act requires this Council to conduct a public hearing on said proposal and to publish notice of said public hearing not less that fifteen (15) days nor more than thirty ;30) days pri;r to the date fixed for the hearing; and WHEREAS, the Borrower has delivered to this Council a draft copy of a proposal appli- cation to the Minnesota Commissioner of the Department of Energy, Planning and Devel- opment, together with all attachments and exhibits thereto, and sai� application, attachments and exhibits are now on file with the City Clerk. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PLYMCUTH, MINNESOTA, THAT: 1. A public hearing shall be conducted by this Council on the proposal to under- take and finance the Project on April 11, 1983, at 7:30 o'clock p.m., at the city hall, 3400 Plymouth Boulevard in the City, at which hearing all parties who appear shall be given an opportunity to express their views with respect to said proposal. 2. Notice of the time and place of hearing, which shall state the general nature of the Project and an estimate of the principal amount of the bonds or other obligations to be issued to finance the Project, shall be published at least once not less than fifteen (15) days nor more than thirty (30) days prior to the date fixed for.the hearing in the official newspaper and in a newspaper of general circulation of the City. The notice shall state that a draft copy of the proposed application to the Minnesota Commissioner of Energy, Planning and Development, together with all attachments and exhibits thereto, shall be available for inspection following the publication of such notice and shall specify the place and times such applciation and its exhibits and attachments shall be so available. The motion for adoption of the foregoing Resolution was duly seconded by Councilmembtr Neils , and upon vote being taken thereon, the following voted n favor thereof: uncilmembers Moen, Neils, Schneider and Threinen . rte following voted against or abstained: M Whereupon the Resolution was declared duly pas i` t NOTICE OF PUBLIC HEARING ON PROPOSED PROJECT AND THE ISSUANCE OF INDUSTRIAL DEVELOPMENT REVENUE HANDS UNDER THE MUNICIPAL INDUSTRIAL DEVELOPMENT ACT, MINNESOTA STATUTES, CHAPTER 47W-, AS AMENDED CITY OF PLYMOUTH, MINNESOTA NOTICE IS HEREBY GIVEN that the governing body of the City of Plymouth, Minnesota (the "City"), shall meet on April 11, 1983, at 7:30 o'clock p.m., at the city hall, 3400 Plymouth Boulevard in the City, for the purpose of conducting a public hearing on a proposed issue of Industrial Development Revenue Bonds (the "bonds") under the Minnesota Municipal Iadustrial Development Act, Minnesota Statutes, Chanter 474, as amended, to undertake and finance a project or. behalf of Gary R. i3luein ( the "Borrov er") . The project shall consist of construction of a new offica and light manufacturing facility (the "Project") and shall be located at 2500 Niagra Lane in the City. The estimated total amount of the proposes bond issue is x450,000. The bonds snall be limited obligations of the City, and the bonds and interest thereon shall be payable solely frcin the revenue pledged to the payment thereof, except that such bonds may be secured i,)r a mortgage and other encumbrances on the Project. No holuer of any such bond shall ever have the right to compel any exercise of t;:e taxing power of the City to pay the bonds or the interest tnereon nor to enforce payment against any property of the City cxceut '_Oe Project. A draft copy of the proposed application to the Minnesota Commissioner of Energy, Planning and Development for approval of the Project, together with all attachments and exhibits thereto, is available for public inspection at the offices of the city, 3400 Plymouth Boulevard, Plymouth, Minnesota, weekdays between the hours of 8:00 a.m. and 4:30 p.m. Dated: March 14, 1983. 3Y ORDER Oe TETE CITY COUNCIL City Clerk
