HomeMy WebLinkAboutCity Council Resolution 1983-109WHEREAS, the City of Plymouth has undertaken Project No. 205; and
WHEREAS, in order to construct the improvments certain permanent and temporary
easements are required; and
WHEREAS, the City Council finds it necessary, proper and expendient in the
interest of the public health, convenience and general welfare of the citizens
of the City of Plymouth for the City to acquire said easements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that the City Attorney is hereby authorized to commence
condemnation proceedings for Project No. 205 for the following described
easements over the following described parcels:
1. A perpetual easement 100 feet in width for public street purposes over,
under and across the Southeast quarter of the Northeast quarter of Section
22, Township 118, Range 22, Hennepin County, Minnesota. The centerline of
said easeme+tt being described as follows;
Beginning at the point of intersection of the North line of said Southeast
quarter with the centerline of County Road No. 154 as platted and dedicated
In Heritage Estates, according to the recorded plat thereof; thence
Southwesterly along the extension of said centerline of County Road No. 154,
being a curve concave to the Northwest have a radius of 1432.40 feet, a
central angle of 15 degrees 43 minutes 20 seconds and an arc distance of
393.06 feet to a point hereinafter referred to as Point "A"; thence
continuing Southwesterly 739.34 feet along last described curve having a
radius of 1432.40 feet, and a central angle of 29 degrees 34 minutes 25
seconds; thence Southwesterly and tangent to last described curve 621.87
feet to the South line of said Southast quarter of Northeast quarter and
there terminating. The side lines of said easement are to be prolonged or
shortened to terminate at the North and South lines of said Southeast
quarter of Northeast quarter.
And
A perpetual easement for public street purposes over, under and across the
Southeast quarter of the Northeast quarter of Section 22, T 118, R 22
described as follows:
That part of the above parcel lying within a circular arc having a radius of
60 feet and a center radius point located 60 feet Northwesterly of the most
Northerly corner of Lot 1, Block 2, Westminster Addition as measured along
the Southwesterly right-of-way line of 30th Avenue extended.

Together with a temporary construction easment over, under and across the
first above described property. Said temporary construction easment being
150 feet West and Northwesterly of the above described centerline and lyin,j
150 feet Southeasterly of that part of the above described centerline lying
Southwesterly of Point "A".
Together with a public bikeway easement 30 feet in width over, under and
across the first above described property.
Said bikeway easement lying between a line 50 feet Southeasterly of an a
line 80 feet Southeasterly of that part of the above described centerline
lying Southwesterly of said Point "A".
2. A perpetual easement 66 feet in width for public street purposes over, under
and across the Southeast quarter of the Northeast quarter of Section 22,
Township 118, Range 22, Hennepin County, Minnesota. The centerline of said
easement being described as follows:
Commencing at the point of intersection of the North line of said Southeast
quarter with the centerline of County Road No. 154 as platted and dedicated

being a curve concave to the Northwest having a radius of 1432.40 feet and a

Southeasterly along the prolongation of a radial line of said curve 103.29
feet; thence Southeasterly along a tangential curve concave to the Southwest
having a radius of 884.54 feet, a central angle of 28 degrees 45 minutes 22
seconds an arc distance of 443.94 feet and there terminating.
Together with a temporary construction easement being 113 feet in width and
the North line of said temporary construction easement is coincident with
the above described centerline.
3. A perpetual easement 20 feet in width for public utility purposes over,
under and across the Southeast quarter of the Northeast quarter of Section
22, Township 118, Range 22, Hennepin County, Minnesota.
The centerline of said easement being described as beginning at a point on
the South line of said Southeast quarter of Northeast quarter distant
996.59 feet West from the Southeast corner thereof; thence Northwesterly at
an angle of 53 degrees 23 minutes 48 seconds as measured from West to North
a distance of 100 feet and there terminating.
4. That part of the Southeast quarter of the Northeast quarter of Section 22,
Township 118, Range 22, Hennepin County, Minnesota, lying West of County
Road No. 154 and being described as beginning at the point of intersection
of the North line of said Southeast quarter with the centerline of County
Road No. 154 as platted in Heritage Estates, according to the recorded plat
thereof; thence Southwesterly 393.06 feet along the extension of said
centerline being a curve concave to the Northwest having a radius of 1432.40
feet and a central angle of 15 degrees 43 minutes 20 seconds; thence
Southeasterly along the prolongation of a radial line of said curve 103.29
feet; thence Southeasterly along tangential curve concave to the Southwest
having a radius of 884.54 feet, central angle of 13 degrees 17 minutes
57 seconds, an arc distance of 205.83 feet more or less to the East line of
said Southeast quarter of Northeast quarter; thence North along said East
line to the Northeast corner of said Southeast quarter; thence West along
the North line of said East line to the Northeast corner of said.Southeast
quarter; thence West along the North fine of said Southeast quarter 151.58
feet more or less to the point of beginning. Except the Westerly 50 feet
thereof and exept the Southerly 33 feet thereof.
5. A perpetual easement for public utility purposes over, under and across the
West 25 feet of the East 35 feet of the South 120 feet of the North 639 feet
of Outlot F, Northwest Business Campus, Hennepin County, Minnesota,
according to the recorded plat thereof.
And
A perpetual easement for public utility purposes over, under and across the
West 13 feet of the East 23 feet of the South 1045 feet of the North 1184
feet of said Outlot F.
Together with a temporary construction easement over, under and across the
North 1283.92 feet of the West 13 feet of the East 23 feet of said Outlot F.
7. A perpetual easement for public roadway purposes over, under and across the
East 13.50 feet of the West 30 feet of that part of the North half of the
Southwest quarter of the Northeast quarter of Section 22, Township ,18,
Range 22, Hennepin County, Minnesota, lying South of the North 330 feet
thereof.
And
A perpetual easement for public utility purposes over, under and across the
East 26 feet of the West 56 feet of the South 65 feet of said North half of
Southwest quarter of Northeast quarter of Section 22.
And a perpetual easement for drainage and pondinq consisting of the
following described parcel:
Commencing at the Southwest corner of said North half of SW 1/4 of HE 1/4 of
Section 22, lying South of the North 330 feet, thence East along the South
line a distance of 55 feet to actual point of beginning, thence North along
a line parallel to the West line a distance of 65 feet, thence deflecting to
the Southeast to a point of the South line a distance of 170 feet East of
the Southwest corner of said North half of SW 1/4 of HE 1/4 of Section 22,
lying South of the North 330 feet, Section 22, T 118, R 22.
And a temporary construction easement consisting of:

Hennepin County, Minnesota.
Together with a temporary construction easement over, under and across the
East 10 feet of the Wes_ 40 feet, and the East 10 feet of the West 50 feet
of the South 200 feet, and the East 10 feet of the West 60 feet of the South
100 feet all in the North 330 feet of said Southwest quarter of Northeast

North of the South 30 feet thereof.
Together with a temporary construction easement over, under and across the
West 10 feet of the East 40 feet of that part of said South half of North
half of Northwest quarter of Section 22, lying South of North 360 feet
thereof and North of the South 30 feet thereof.
10. A perpetual easement for public roadway purposes over, under and across the
West 13.50 feet of the East 30 feet of the South 100 feet of the North 360
feet of South half of the North half of the Northwest quarter of Section 22,
Township 118, Range 22, Hennepin County, Minnesota.
Together with a temporary construction easement over, under and across the
West 10 feet of the East 40 feet of said South 100 feet of North 360 feet of
South half of North half of Northwest quarter of Section 22.
13. A perpetual easement for public roadway purposes over, under and across the
East 13.50 feet of the West 30 feet of the South 280 feet of the South half
of the North half of the Northwest quarter of the Northeast quarter of
Section 22, Township 118, Range 22, Hennepin County, Minnesota.
Together with a temporary construction easement over, under and across the
East 10 feet of the West 40 feet of the South 280 feet of said South half of
North half of Northwest quarter of Northeast quarter of Section 22.
14. A perpetual easement for public roadway purposes over, under and across the
East 13.50 feet of the West 30 feet of that part of the South half of the

Beginning at a point in the West line of said South half of Northwest
quarter of Northeast quarter of Section 22, distant 565 feet North from the
