Councilmei. r Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 83-53
AMENDING RESOLUTION NO. 82-620 TO DELETE CONDITION NUMBER 4 REGARDING COMPLIANCE WITH
FIRE CODE, SECTION 905 FOR THE LOCATION OF FIRE HYDRANTS AND FIRE LANES FOR DONALD C.
WILDMAN FOR THE SITE PLAN FOR AN INDUSTRIAL BUILDING LOCATED SOUTHWEST OF 27TH AVENUE
NORTH AND FFRNBROOK LANE (82062)
WHEREAS, the City Council considered a variance request from the fire lane requirements
established in the City Code, Section 905 at their December 6, 1982 meeting; and,
WHEREAS, the City Council approved Resolution No. 82-620 which establishes in condition
number 4 that the development shall comply with the City Fire Code regarding the
location of fire hydrants and fire lanes; and,
WHEREAS, Donald C. Wildman, has requested the City Council reconsider the request of a
variance from the City Code, Section 905, fire lane requirements for the west side of
an industrial building to be located at the southwest corner of 27th Avenue North and
Fernbrook Lane;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does amend Resolution No. 82-620 Condition Number
4 which requires compliance with the City Fire Code, Section 905 relating to fire lane
requirements for Donald C. Wildman for the Site Plan for an industrial building to be
located southwest of 27th Avenue and Fernbrook Lane, to read as follows:
1. Compliance with the City Fire Code regarding the location of fire hydrants and
fire lane, providing however, that the fire lane and hydrant along the west
side of the building meed not be constructed at this time.
2. The fire lane and hydrant requirements for the west side of the subject
property shall be re-evaluated at the time the adjacent lot to the west
develops. If the Council determines a need for a fire lane and hydrant, such
fire lane and hydrant shall be constructed in accordance with the City Code,
Section 905, by the then property owner at the expense of the then owner
of the -property.
The motion for adoption of the foregoing Resolution was duly seconded by
and upon vote being taken thereon, the
following vote in favor thereof:

Whereupon the Resolution was declared duly passed and adopted.
