HomeMy WebLinkAboutCity Council Resolution 1983-051Cgunrilmomber Moen introduced the followinq Resolution and moved its adoption: RESOLUTION NO. 83-51 ADOPTING ASSESSMENT SANITARY SEWER AND WATERMAIN - WEST MEDICINE LAKE TERRACE ADDITION PROJECT NO. 241 WHEREAS, in conformance with the development contract we have received a waiver of assessment hearing from the property owner of West Medicine Lake Terrace Addition waiving their their right to special assessment hearinqs coverinq the Installation of sanitary sewer trunk facilities, water trun4 facilities and all other appurtenances; NOW, THEREFORE, BE IT HEREBY RESOLVED BY PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of hereof, is hereby accepted and shall against the lands named therein and hereby bound to be benefited by the the assessment levied against it. THE CITY COIINCIL OF THE CITY OF which is attached hereto and made constitute the special assessment each tract of land herein included proposed improvement in the amount part Is of 2. Such assessment shall be payable in equal annual installments extendino over a period of 5 years, the first of the installments to be payable on or before the first Monday in January 1984 and shall bear interest at the rate of 10.33% per annum from the date of adoption of this assessment resolu- tion. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1984. To each subsequent installment when due shall be added interest of one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certifica- tion of the assessment to the County Finance Director, pay the whole of the assessment on such property with interest accrued to the date of payment to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty days from the adoption of this resolution; and he may, at any time thereafter, pay to the City Finance Director the entire amount of the assessment remaining unpaid with interest accrued to December 31 of the year in which the payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this resolution is 985,500.00. The motion for the adoption of the foregoing Resolution was duly seconded by cnuneilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils, Crknaidar and Threinen The follo rhereupon w� est or austaunen: was declared duly .
