Councilmember Moen introduced the following Resolution and
Moved its adoption:
RESOLUTION NO. 83- 34
REQUEST FOR PAYMENT NO. XI AND FINAL FOR MISSION, SCHMIDT
AND TIMBER SHORES NEIGHBORHOOD PARKS
PROJECT 106/107/108
WHEREAS, the City of Plymouth as owner and Minnesota Valley Landscape, Inc.
as contractor have entered into an agreement for neighborhood park improve-
ments, said agreement being dated July 1, 1981, and
WHEREAS, the Director of Park and Recreation has certified his acceptance
of the work and his approval of the final request for payment,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $223,792.41 and that
_ change orders were approved amounting to $13,634.48 and that
the work completed to date is in the amount of $237,426.89.
2. That the work performed by the contractor for Project No.
106/107/108 and certified to the Council by the Director of
Park and Recreation as acceptable be and the same is hereby
released from the contract except as to the conditions of the
performance bond, any and all legal rights of the owner,
required guarantees and corrections of faulty work after
final payment.
3. Request for Payment No. XI and Final in the amount of
$11,871.34 to Minnesota Valley Landscape, Inc., for Project
No. 106/107/108 is hereby approved and the City Finance
Director is hereby authorized and directed to pay the same
forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Threinenand upon vote being taken thereon, the
following voted in favor t ereo : Mayor Davenport, Councilmembers Moen,
Neils, Schneider and Threinen
Tne following voted against or abstained: none
