The following members were �reSent:Maxor Daunport. Councilmember Moen Neils Schneider & Threinen he following members were absent: none Couqcllmembgr Men introduced the following Resolution and moved its adoption: RESOLUTION NO. 83- 31 REQUEST FOR PAYMENT NO. 6 AND FINAL EAST MEDICINE LAKE PARK - BATH HOUSE PROJECT NO. 109 WHEREAS, the City of Plymouth as owner and Maertens-Brenny Construction Co. as contractor have entered into an agreement for the East Medicine Lake Park Bath House improvements, said agreement being dated September 11, 1981; and WHEREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH: 1. That the original contract amount was $82,239.00, one change order 10 in the amount of $2,860.84 was approved, and the value of the work to date is $85,099.84. 2. That the work performed by the contractor for Project No. 109, bath house improvements, and certified to the Council bythe engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and corrections of faulty work after final payment. 3. Request for Payment No. 6 and Final in the amount of $4,444.9C to Maertens-Brenny Construction Co. for Project 109, bath house improve- ments, is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith.
