The following members were present: Mayor DayenpoY't; Councilmembers Koen-71T Ts, —::--1;pand �Threi nen _ _ M F.qe fDllowing members were sent: Vne .tt Councilmember Moen introduced the following Resolution and moved its adoption: RESOLUTION NO. R3-7 APPROVING CONDITIONAL USF PERMIT FOR TIPTON DEVELOPMENT AND CONSTRUCTION, INC. FOR "PLYMOUTH CREEK" (RPUD 80-1) (79006) WHEREAS, Tipton Development and Construction, Inc. has renuested approval of a Conditional Use Permit to fill and excavate 5011 materials within the Floodplain Overlay District, as defined by the Flood Insurance Study for the City of Plymouth and according to the provisions of Section 6 of the Plymouth Zoninq Ordinance, on Outlots A,C,D,E,F, and G "Plymouth Creek" located at the southeast corner of Vicksburq Lane and County Road 9; and, WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE. CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Tipton Development and Construction, live. for a Conditional Use Permit to fill and excavate soil materials within the Floodplain Overlay District as defined by the Flood Insurance Study for the City of Plymouth and aea:rdinq to the provisions of Section 6 of the Plymouth 70nino ordinance, on Outlots A,C,D,E,F, and G "Plymouth Creek" located at the southeast corner of Vicksburg Lane and County Road 9 subject to the followinq conditions: 1. Compliance with the Engineer's Memorandum.
