Pursuant to due call and notice thereof, a meetinq of the City Council of

Davenport introduced the followinq Resolution and moved its
adoption:
RESOLUTION NO. 83- 4
SETTING CONDITIONS TO BE MET PRIOR TO FILING AND REGARDING FINAL PLAN/PLAT FOR
"SCOVILLE BUSINESS PARK" FOR DONALD C. WILDMAN (82062)
WHEREAS, the City Council has approved the Final Plan/Plat and Development Contract for
"Scoville Business Park" as requested by Donald C. Wildman;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the following conditions to be met
prior to recording and regardinq said plat:
1. Compliance with the City's Engineer's Memorandum
2. The Ordinance rezoning the property shall be published upon evidence that the
Final Plat has been filed and recorded with Hennepin County.
3. Provisions for a 30 -ft. wide trail easement per Comprehensive Park Plan, as
verified by the Parks and Engineerinq Departments, with submittal of detailed
plans as to grading of the trail per City standards; the trail plans shall be
coordinated with the site landscaping plans so to enhance future pavino of the
trail and to minimize construction problems.
4. Payment of park dedication fees -in -lieu of dedication in an amount determined
according to verified acreage and according to the Dedication Policy in effect
at the time of Building Permit issuance. Trail paving is deferred and the
trail shall be graded at the petitioner's expense.
5. No building permits shall be issued until municipal sewer and water are
physically available to the sites.
6. Removal of all dead or dying trees from the property at the owner's expense.
7. Removal of existing structures at the developer's expense concurrent with
initial plat grading.

B. No yard setback variances are granted or implied.
9. No building permits to be issued until the Final Plat is filed and recorded
with Hennepin County.
10. Appropriate legal documents regarding the shared private drive easement for
Lots 2 and 3 be submitted prior to filinq the Final Plat with Hennepin County.
11. All existing equipment and debris shall he removed concurrently with Initial
grading of plat.
The notion for adoption of the foregoing Resolution was duly seconded by
- Counci1member Schneider , and upon vote being taken thereon. the
