introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 82- 654
AMENDING DEVELOPMENT CONTRACT FOR ZACHARY COURT ADDITION (79045)
WHEREAS, the City Council approved the final plat and development contract for the
Zachary Court Addition plat on July 21, 1980 by Resolution No. 81-346; and
WHEREAS, the development contract was executed by Marvin H. Anderson Construction
Co. on May 29, 1981; and
WHEREAS, the development contract provides that the developer shall install and
complete the improvements to this plat on or before December 31, 1982; and
WHEREAS, the developer has requested an extension of time to October 1, 1984 for
completion of the required public improvements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH
that the development contract between the City and Marvin H. Anderson Construction
Co. for the Zachary Court Addition approved by Resolution No. 81-346 is hereby
amended to provide that the developer shall complete all the required improvements
within the plat on or before October 1, 1984.
The motion for the adoption of the foregoing Resolution was duly seconded by
C un ilmember Threinen , and upon vote being taken thereon, the
following voted in favor ereo Mayor Davenport, Councilmembers Moen,
Neils Schneider and Threinen
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
