Pursuant to due call and notice thereof, a regular Meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 6th day of December . 19 82.

The following members were absent: none
Mayor Davenport introduced the following Resolution and Moved its
adoption:
RESOLUTION NO. 82- 635
APPROVING CONDITIONAL USE PERMIT AMENDMENT FOR PATRICIA DONNELLY FOR USE OF RECREATION
BUILDING AND RAILROAD CAR LOCATED ON PART OF LOT 2, BLOCK 2, FOX MEADOWS FIRST ADDITION

WHEREAS, a petition has been submitted on behalf of Patricia Donnelly, d/b/a Area
Advisors, Incorporated, requesting a Conditional Use Permit Amendment regarding the use
of the railroad car for office purposes and the use of the recreation building in the
Fox Meadows Office Complex at 3020 Harbor Lane; and,
WHEREAS, the then Village Council approved a Conditional Use Permit under Resolution
No. 71-63 on February 22, 1971 for a recreational facility and restored railroad car
10 for a conference room; and,
WHEREAS, City Council initially considered and deferred action on this request on
January 9, 1978; and,
WHEREAS, the City Council has also considered this matter in conjunction with request
to divide the property, most recently on October 6, 1980; and,
WHEREAS, the City Council has directed that staff and the Planning Commission review
the present use of the railroad car relative to the original conditional use permit and
to determine the proper use and status;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request for Patricia Donnelly for
an amendment to the Conditional Use Permit for the recreational facility and restored
railroad car in the Fox Meadows Office Complex to allow an office use in the railroad
car in conjunction with operation of the recreational facility subject to the following
conditions:
1. The permit is issued to the petitioner as operator and owner and is not
transferable without review and approval by the City Council.
2. There shall be a maximum of three employees.
3. There shall be no commercial sale of food or beverages in the railroad car.

• 4. The owner shall maintain the railroad car in a sound and safe condition; if
the Building Official finds that the car is unsafe or is not heing properly
maintained, appropriate steps shall be initiated as provided for by City Code
to order necessary corrective action which, if not taken, shall result in the
matter being referred to the City Council for consideration of revocation of
the permit and removal of the railroad car from the premises.
5. The use of the recreation building and racquet ball facility shall be
ancillary to the use of the railroad car and limited to the owners, occupants,
and lessees of that railroad car and guests of the same.
6. A minimum nine parking spaces adjacent to the recreation building shall be
striped and designated for use by persons usinq the recreation facility and/or
the railroad car.
7. Issuance of this permit is based on the finding that the proposed use is
compatible with the original authorization for the recreational facility and
railroad car; although it is acknowledged that the present ownership and use
of those facilities no longer have any proprietary or operational relationship
with the Fox Meadows Office Complex.
8. A copy of the Conditional Use Permit Resolution shall be filed with Hennepin
County.
9. No advertising signage for the racquet ball use shall be allowed other than
that which is presently in use.
FURTHER, Resolution No. 71-63 is hereby rescinded.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Threinen , and.upon vote being taken t ereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils,
Ti—ming votedagainst 'abstainea: none
Whereupon the Resolution was declared duly passed and adopted.
