HomeMy WebLinkAboutCity Council Resolution 1982-633CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regularmeeting of the City Council of the City of Plymouth, Minnesota, was held on the 6th day of December , 1982. The following members were present: MayorDavennort��ounciImem bers Moen, s, " Schder and Threinen Ine 0 owing members were' absent: none _ MMaavnr Davenoort introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-633 APPROVING SITE PLAN, CONDITIONAL 'JSE PERMIT AND VARIANCES FOR DONALD POUPARD (82050) WHEREAS, Donald Poupard has requested approval of a Site Plan, Conditional Use Permit and Variances for a 4,900 sq. ft. Class I Restaurant to be located southeast of 27th Avenue North and Annapolis Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends its approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Donald Poupard for Site Plan, Conditional Use Permit and Variances for a 4,900 s4. ft. Class I Restaurant to be located southeast of 27th Avenue North and Annapolis Lane, subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with Dedication Policy in effect at the time of Building Permit issuance. 3. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 4. Any subsequent phases or expansions are subject to required review and approval per Ordinance provisions. 5. The Conditional Use Permit is issued to the petitioner as operator of the facility and shall not be transferable. 6. All waste and waste containers shall be stored within approved facilities shown on the plans dated October 1, 1982. 7. there shall be no outside display, sales or storage of merchandise. 8. The number, type and size of all signs shall be per Ordinance standards; the minimum setback for the freestandinq sign shall be 20 feet. dsk2-A Page 2 Resolution No. 82-633 9. Approved variances include: a. building rear yard setback to east property line (5 ft. vs 35 ft.): b. parking setback to west side of buildinq (5 ft. vs 10 ft.); e. parking setback to east property line (15 ft. vs 20 ft.); d. parking setback to south property line (5 ft. vs 20 ft.): e. parking setback to west property line (9.2 ft. vs 20 ft.): f. fire lane g. parking lot setback to the north property line (1 ft. vs 20 ft.).
