HomeMy WebLinkAboutCity Council Resolution 1982-628Pursuant to due call and notice thereof, a regular- meeting of the City Council of the City of Plymouth, Minnesota, was held on the 6th day of 'Decgmber . 19 82. The following _members were present: MMav r Daven t--, Tounq)1 membet�'P�den,- 10�TTS , 1 � ohe , e absent:_ none Magor Davenport introduced the following Resolution and moved its adoption: - RESOLUTION NO. 82- 628 SETTING CONDITIONS TO BE MET PRIOR 'TO FILING AND REGARDING MPUD NO. 78-1 FINAL PLAN/PLAT FOR "FOX GLEN THIRD ADDITION" FOR JOHN ANDERSON, ZACHMAN HOMES, INC. (A-814) WHEREAS, the City Council has approved the Final Plan/Plat and Development Contract for "Fox Glen Third Addition" as requested by Zachman Homes, Inc.; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following conditions to be met prior to recording and regarding said plat: 1. Compliance with City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Findl Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of filing the Final Plat. 4. No Building Permits shall be issued until municipal sewer and water are physically available to the site. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Yard setbacks per approved PUD Plan. 7. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. S. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 9. Appropriate legal documents regarding Homeowner Association covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat. Page two Resolution No. 82-628 10. Signage approved per PUD Plan. 11. Approval shall include the lot divisions for the two -unit dwellings subject to approval by the City Engineer who shall review submitted "as-huilt" surveys of the constructed units which indicate the legal descriptions; and who shall determine what, if any, adjustments and levies are necessary relative to assessments prior to filing the divisions with the County. 12. Approval is subject to applicable conditions of the Resolutions and Development Contracts for the "Criterion PPUD 78-1"(A-814).
