The following members were present: Mayor Davenport, ouncilmembers Moen, We -"Ms, — &pbUgiopr and einen The following rs were absent: none t� t� MaXor Davenport Introduced the followinq Resolution and moved its adoption: RESOLUTION NO. 82-619 APPROVING PRELIMINARY PLAT FOR DONALD C. WILDMAN FOR "SCOVILLE RUSINFSS PARK" AT THE SOUTHWEST CORNER OF 27TH AVENUE NORTH AND FERNBROOK LANE (82062) WHEREAS, Donald C. Wildman has requested approval of rezoning from FRD (future restricted development) District to I-1 (planned industrial) District, and a preliminary plat for three industrial lots at the southwest corner of 27th Avenue North and Fernbrook Lane; and, WHEREAS, the Planning Commission has considered the requests following a duly called Public Hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a preliminary plat for "Scoville Business Park" consisting of three industrial lots at the southwest corner of ?7th Avenue North and Fernbrook Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. Provisions for a 30 -ft. wide trail easement per the Comprehensive Park Plan, as verified by the Parks and Engineering Departments, with submittal of detailed plans as to grading of the trail per City Standards; the trail plans shall be coordinated with the site landscaping plans so to enhance future paving of the trail and to minimize construction problems. 4. Payment of park dedication tees -in -lieu of dedication in an amount determined according to verified acreage and according to the Dedication Policy in effect at the time of Building Permit issuance. Trail paving is deferred and the trail shall be graded at the petitioner's expense. 5. Rezoning shall be finalized with filing of the Final Plat. 6. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. Page two Resolution No. 82- 619 7. No yard setbacks are granted or implied. 8. Appropriate legal documents regarding the shared private drive easement for Lots 2 and 3 be submitted as part of the Final Plat Applications. 9. Removal of existing structures at developer's expense concurrent with initial site grading. The motion for adoption of the foregoing Resolution was duly seconded by Souncylmember Neils , and upon vote heinq taken,t ereon, the following voted in favor thereof: Mayor -Davenport, Eotncilmember's Moen, Neils, The T"ollowing voted against or -abstained: none ■hereupon the Resolution was declared duly passed -and adopted. dsk2A
