HomeMy WebLinkAboutCity Council Resolution 1982-599CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 5th day of November 1982. The following members were present: Mayor Davenport, Councilmembers Moen, Neils, The following members were absent: none Cguncilmember Threinen introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-599 APPROVING AMENDMENT TO RESOLUTION NO. 82-473 WHICH APPROVED THE SITE PLAN AMENDMENT AND VARIANCE FOR FOXGLOVE PROPERTIES FOR UPSHER-SMITH LABORATORIES, INC. LOCATED AT 14905 23RD AVENUE NORTH (A-696) WHEREAS, Foxglove Properties has requested an amendment to Resolution No. 82-473 approved by the Plymouth City Council at their September 13, 1982 meeting, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the amendment to Resolution No. 82-473 approved by the Plymouth City Council at their September 13, 1982 meeting and which reads as follows: Approved variance involves the proof -of -parking plan which indicates that 31 parking stalls of the 127 stalls which would be required if the facility were used for multiple and/or manufacturing uses, cannot be provided within Ordinance standards on this site; thereby limiting current and future uses and occupancy of this facility to those consistent with Zoning Ordinance parking requirmen;­ In the event the property subject to this variance is mortgaged by Fuxglove Properties or Upsher-Smith Laboratories, Inc. for purposes of financing property improvements and any such mortgage is foreclosed or a deed given in lieu thereof, this variance is deemed amended to read to allow lawful use and occupancy of the facility with 96 parking stalls. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Moen , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils, Schneider and Threinen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
