HomeMy WebLinkAboutCity Council Resolution 1982-550CITY OF PLYMd1TM Pursuant to due call and notice thereof, a ragular meeting of the City 1bCouncil of the City of Plymouth, Minnesota was held on the lAth day of October , 1982. The following members were present: M r Davenport, CaMneil rs Moen Neils and Schneider The following members were a Councilmember Threinen Councilmember Moenintroduced the following Resolution and moved its adoption - RESOLUTION NO. 82.550 AUTHORIZING THE VACATION OF UTILITY AND DRAINAGE EASEMENT ON LOT 1, BLOCK 2, METRO INDUSTRIAL PARK ADDITION WHEREAS, a petition was received to vacate a portion of the utility and drainage easements on Lot 1, Block 2, Metro Industrial Park Addition; and WHEREAS, a public hearing with respect to said vacation was held on October 18, 1982 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of October 18, 1982; and WHEREAS, the Council did hold a public hearing on October 18,1982 to inform any and all interested parties relevant to the vacation of the utility and drainage easements on Lot 1, Block 2, Metro Industrial Park; and WHEREAS, it was determined by the City Council that said easements are not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH as follows: 1. All that part of the 10 foot utlility and drainage easement as dedicated in the plat of Metro Industrial Park, filed in the office of the County Recorder, Hennepin County, Minnesota adjoining the northerly and north- westerly line of Lot 1, Block 2, Metro Industrial Park which lies east of the west line of the east 570 feet of said Lot 1. 2. Further, that said vacation shall not affect the authority of any person, corporation or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon and thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by CouncilmemWr Neils , and upon vote being taken thereon, the -following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Neils SChnpiti The following owing voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
