option:
RESOLUTION NO. 82-535
APPROVING VARIANCE REQUEST FOR MR. NORBERT FISCHER, 545 ORCHID LANE NORTH
WHEREAS, Mr. Norbert Fischer, 545 Orchid Lane North, has requested a 22 foot variance
from the City's Zoning Ordinance to permit construction of an addition to an existing
attached gdrage to within 13 feet of the property line; and,
WHEREAS, Lhe request was reviewed by the Board of Zoning Adjustments and Appeals on
August 9, 1982 and on September 13, 1982, at which time the Board ruled to deny the
request; and,
WHEREAS, the petitioner has appealed the ruling of the Board;
NOW, THEREFORE, HE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request of Mr. Norbert Fischer
for a 22 foot front yard setback variance from 6th Avenue North to permit construction
of a 9 foot addition to an attached garage, based upon the following findings:
1. The request is consistent with the Zoning Ordinance Variance Criteria.
2. There have been similar past actions in this area and the proposal would be in
keeping with the character of the area.
3. There is an existing garage and it has been demonstrated that to extend the
garage anywhere else on the site would constitute a hardship.
The motion for adoption of the foregoing Resolution was duly seconded by
Ma,gnr pavpgport , and upon vote being taken thereon the
following voted in favor thereof: Mayor Davenport, Councilmembers Moen, Schneider

Whereupon the Resolution was declared duly passed and adopted.
