The following members were present: ct' ti g Afayor Schneider, rnianri lmamhars Mnen _ Neils and Threi nen AAA AAA AAA Councilmember Moen introduced the following Resolution and moved its tion: RESOLUTION NO. 82-619 1983 LAWCONACMR GRANT - LAND ACQUISITION FOR WEST MEDICINE LAKE CITY PARK WHEREAS, the Land and Water Conservation Fund Act and the State Natural Resources Fund provides for the making of grants to assist local public bodies in the acquisition and development of outdoor recreation projects, and WHEREAS, the City of Plymouth desires to acquire and develop certain land known as West Medicine Lake Park, which land is to be held and used for permanent open space, and WHEREAS, in order for the proposed project to be eligible for approval, there must be proof that it is part of a comprehensive outdoor recreation Flan and 5 -year action program (capital improvement), and WHEREAS, the City of Plymouth has an original or revised 5 -year action program which includes West Medicine Lake Park, and WHEREAS, it is estimated that the cost of acquiring said interest(s) shall be $150,000, and WHEREAS, upon project approval the City of Plymouth must enter into formal grant project agreements with the state for the specific purpose of acquiring West Medicine Lake City Park, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That an application be made to the State of Minnesota, Department of Energy, Planning and Development, Office of Local Government for a grant from 0,e Land and Water Conservation Fund of 1965 as amended for an amount presently estimated to be $75,000 and the applicant will pay the balance of cost from other funds available to it. 2. That an application be made to the State of Minnesota, Department of Energy, Planning and Development, Office of Local Government for a grant from the Natural Resource Fund (Minnesota Laws, 1979, Chapter 333, Section 31, Sub- division 3, paragraphs (c) and (d) for an amount presently estimated to be $75,000 and the applicant wfitl pay the balance of the cost from other funds available to it, Resolution # 82-519 Page 2 3. That the Mayor and City Manager are and directed to execute and file A) such application and B) the 5 -year action program with the State of Minnesota, Department of Energy, Planning and Development, Office of Local Government, and to provide additional information and furnish such documents as may be required by said Department, and C) to act as the authorized correspondents of the applicant. 4. That the proposed acquisition and development is in accordance with plans for the allocation of land for open space uses, and that should said grant be made, the applicant will acquire, develop and retain said land for use(s) designated in said application and approved by the Office of Local Government and the National Park Service (NPS). 5. That the United States of America and the State of Minnesota be, and they hereby are, assured of full compliance by the applicant with the regulations of the Department of the Interior, affectuating Title VI of the Civil Rights Act of 1964. 6. That the City of Plymouth enter into an agreement with the State of Minnesota Department of Energy, Planning and Development, Office of Local Government to provide such grants as are specified in numbered paragraphs 1 and 2, above, for the year(s) 1982-1985 7. That the Mayor of Plymouth and/or the City Manager are authorized and directed to execute such agreement and any supplemental agreements therof.
