HomeMy WebLinkAboutCity Council Resolution 1982-511CITY OF PLYMOUTH Pursuant to due call and notice thereof, aronular meeting of the City Council of the City of Plymouth, Minnesota was held on the 20th day of September , 19 82. The following members were presentMa or Daven ort Councilmembers Moen Neils Schneider & Threinen The following members were absent: none Councilmember Moen introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-511 REQUEST FOR PAYMENT NO. 12 AND FINAL 49TH AVE., 51ST AVE. AND 10TH AVE. IMPROVEMENTS PROJECT NO. 904, 004 AND 007 WHEREAS, the City of Plymouth as owner and Nodland Associates, inc. as contractor have entered into an agreement for the 49th Ave., 51st Ave. and 10th Ave. improve- ments, said agreement being dated June 27, 1980; and WHEREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH: 1. That the original contract amount was $523,354.35, four change orders were approved in the amount of $156,306.40, and the value of the work to date is $674,725.17. 2. That the work performed by the contractor for Project No. 904, 004 and 007 and certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bund, any and all legal rights of the owner, required guarantees and corrections of faulty work after final payment. 3. Request for Payment No. 12 and Final in the amount of $34,376.67 to Nodland Associates, Inc. for Project 904, 004 and 007 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the 0 ow ng voted n favor thereof: Mayor Davenport,, Council members Moen, Neils, Schneider and Threinen The following vote against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
