HomeMy WebLinkAboutCity Council Resolution 1982-485CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Couneil of the City of Plymouth, Minnesota was - the 13th day of September , 1982. The following members were present Ryor Davenport, f'nuncilmambers Koen. Neils, Schneider & Threinen The follow ng members were absent: none rQunrilmenber Schneider introduced the following Resolution and moved its adoption RESOLUTION NO. 82-485 REQUEST FOR PAYMENT NO. 5 AND FINAL COMMUNITY PLAYFIELD IMPROVEMENTS, PHASE III, SCHEDULE F PROJECT NO. 017 WHEREAS, the City of Plymouth as owner and Tennis West, Inc. as contractor have entered into an agreement for the Community Playfield Improvements, Phase III, Schedule F, said agreement being dated June 25, 1981; and WHLREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment; NOW, THEREFORE, HE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $125,660.00, no change orders were approved, and the value of the work to date Is $127,610.00. 2. That the work performed by the contractor for Project No. 017, Phase II1, Schedule F, and certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and corrections of faulty work after final payment. 3. Request for Payment No. 5 and Final in the amount of $19,922.75 to Tennis West, Inc. for Project 017, Phase III, Schedule F, is hereby approved and the City Finance Director is hereby author- ized and directed to pay the same forthwith. The motion for the adoption of of the foregoing Resolution was duly seconded by CoWncilmember Neils , and upon vote being taken thereon, the following voted n favor thereof: MaXnr nampnpor-L. Councilmembers Moen, Neils, Schneider — = The o low ng voted against or abstained: none 9hereupon the Resolution was declared duly passed and adopted.
