Introduced the following Resolution and moved its

RESOLUTION NO. 82-477
SLTTING CONDITIONS TO BE MET PRIOR TO FILING OF AND REGARDING FINAL PLAT/PLAN FOR
"CREEKSIDE OF PLYMOUTH" FOR DEAN R. JOHNSON CONSTRUCTION, INC. (RPUD 82-02) (79018)
WHEREAS, the City Council has approved the RPUD Final Plat/Plan and Development
Contract for "Creekside of Plymouth", Phase One, as requested by Dean R. Johnson
Construction, Inc.;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does direct the following to be met prior to and
regardirg recording of said plat:
1. Compliance with City Engineer's Memorandum.
2. The Ordinance rezoning the property shall be published upon evidence
that the Final Plat has been filed and recorded with Hennepin County.
3. Submittal of deeds for Out.lots A and B.
4. Appropriate legal documents regarding Homeowner Association covenants and
restrictions as approved by the City Attorney, shall be filed with the
Final Plat.
5. Signage shall be per Ordinance provisions.
6. The development grading., drainage, and ponding shall be consistent with the
guidelines set forth in the Related Area Environmental Assessment Worksi)pet
for "Plymouth Hills Addition".
7. Submission of financial guarantee and performance agreeeent to assure
completion of approved site improvements prior to issuance of Buildinq
Permits.
8. Building setbacks to be as Indicatt+d on approved plan.
9. Landscaping along Cou+ity Road 9 in the Second Phase area to be completed at
the same time the First Phase is completed.

10. No Building Permits to be issued until municipal sewer and water are avail-
able to the sites, and until the Final Plat has been filed and recorded with
Hennepin County; except that permits may be issued for a model building prior
to filing the plat, provided no Certificate of Occupancy shall be issued un-
til the plat has been filed.
11. A temporary trailer may be authorized by the Building Official for sales
office purposes, provided that it is removed upon completion of the model
unit, or after ninety days from the authorization, whichever occurs first.
The trailer shall be located per Ordinance requirements and appropriate
parking area shall be provided per plans approved by the City.
12. Trail construction within the corridor to the west, and within Outlots A
and B shall be undertaken and completed with Phase I.
