The following members were present: Mayor Davenport, =uncil ers en, ls,— 56bg@;rler and Thrpinpn The following members were absent: none CoUncilmember Moen introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-475 APPROVING C(INDITIONAL USE PERMIT FOR LA PEPINIERE MONTESSORI SCHOOL OPERATING AT THE MOUNT OLIVEr LUTHERAN CHURCH OF PLYMOUTH LOCATED AT 12235 COUNTY ROAD 9 (820371 WHEREAS, the La Pepiniere Montessori School has requested approval of a Conditional Use Permit to operate a school from the Mount Olivet Lutheran Church of Plymouth located at 12235 County Road 9; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of La Pepiniere Montessori School to operate a school from the Mount Olivet Lutheran Church of Plymouth located at 12235 County Road 9 subject to the following conditions: 1. Tie permit is subject to all applicable codes, regulations and Ordinances and violation thereof shall be grounds for revocation. 2. Tke permit is Issued to the tenant as operator of the facility and shall riot be transferable. 3. The site shall be maintained in a sanitary manner. 4. All waste and waste containers shall be stored within approved &.-signated areas as diagrammed on the plans staff dated and srcamped approved. 5. The permit shall be renewed In one (1) year to assure compliance olth the conditions. 6. All portable playground equipment shall be stored Indoors during off -hours. 7. The Montessorl School operation shall be licensed by the State of Minnesota per State regulations, and a copy of the current State license shall be kept on file with the City. The motion for adoption of the foregoing Resolution was daly seconded by Coia&ilmember Schneider , and upon vote belsq taken thereon, Me followliv voted In favor thereof: Mayor Davenport, Lourciltiembers Moen, Neils, Srbppidpr and Threi r 4 o .ILOWIog voted against or abstained: none Whereupon the Resolution was declared duly passed and ted.
