The following members were present: MagQr naypnpgrt,_Councilmembers Moen, eils, The TollowIng members were sent: none Councilmember Moen introduced the following Resolution and moved its adoption: RESOLUTION NO. 82- 469 APPROVING PRELIMINARY PLAN/PLAT, CONDITIONAL USE PERMIT AMENDMENT, AND CONSIDERATION OF REZONING FOR LACHMAN HOMES, INC. FOR "FOX GLEN THIRD ADDITION" (MPUD 78-1) (A-814) WHEREAS, Zachman Homes, Inc. has requested approval of Preliminary Plan/Plat, Conditional Use Permit Amendment, and consideration of rezoning from FRD (future restricted development) District to R-3 (medium density multiple residence) District for "Fox Glen Third Addition" consisting of 20 duplex units, 15 single family dwellings and one existing single family dwelling within the "Criterion MPUD" (78-1) located southeast of Dallas Lane and Fernbrook Lane; and, WHEREAS, the Planning Commission has considered the request following a duly called Public Hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a Preliminary Plan/Plat, Conditional Use Permit Amendment for Zachman Homes, Inc. for "Fox Glen Third Addition" (MPUD 78-1) consisting of 20 duplex units, 15 single family dwellings and one existing single family dwelli:vy, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until municipal sewer and water area physically available to the sites. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. Rezoning shall be finalized with filing of the Final Plat. 7. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 8. Yard setbacks shall be per the staff dated and stamped approved PUD Plan. Page two Resolution No. 82- 469 10 9. Upon approval of the Preliminary Plan/Plat, the Zoninq Map boundary for MPUD 78-1 shall be amended to include ch- Munson property. 10. Approval shall include the lot divisions for the two -unit dwellings subject to approval by the City Engineer who shall review submitted as -built surveys of the constructed units which indicate the legal descriptions; and who shall determine what, if any, adjustments and levys are necessary relative to assessments, prior to filing the divisions with the County. 11. Approval is subject to applicable conditions of the Resolutions and Development Contracts for the "Criterion MPUD".
