The following wedwrs were present: Manor Davenaort—�,ounci lmember—' s Tdoen; Neils, — 11'shpaidpp And Thmi non he TollowIng members wereabsent: none f� Introduced the following Resolution and moved its Adoption: RESOLUTION NO. 82- 468 APPROVING PRELIMINARY PLAT AND VARIANCES FOR LUNDGREN BROTHER'S CONSTRUCTION COMPANY, INC. FOR "KRAETZ LAKE POINTE" LOCATED NORTH OF KRAETZ LAKE, SOUTH OF 24TH AVENUE NORTH ( 82045 ) WHEREAS, Lundgren Brother's Construction Company, Inc. has requested approval of a Preliminary Plat ftr fifteen lots for development of single family detached residential units; and, WHEREAS, the Planning Commission has considered the request following a duly called Public Hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a Preliminary Plat and variances for fifteen single family lots to be known as "Kraetz Lake Pointe" located north of Kraetz Lake, south of 24th Avenue North,subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until municipal sewer and water are physically available to the sites. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing Final Plat. 5. Street name shall comply with the City Street Naming System and be named "23rd Avenue North". 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to or containing any open storm water drainage facility. 7. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 8. No yard setbacks are granted or implied. 9. The Final Plat application shall include a request to vacate the existing r1ght-of-way and drainage and utility easements for Outlot A and Lots 6, 7, and 8, Block 1, Sunny Acres Third Addition. Page two Resolution No. 82-468 10. The existing drive to the existing si.,gle family dwellinq shall be elim- inated and a new access shall be provided to the proposed public road. 11. The existing accessory structure to be used in lieu of a construction trailer shall be used until 85 percent of the property is developed, or three years, which ever occurs first. 12. Approval of the variance from the allowed maximum cul-de-sac length of 500 feet and public road access of 863 feet.
