"ells — T�ollo� wing —members were sent: none .. - *�f CgUncilmember Threinen introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-467 APPROVING PRELIMINARY PLAT AND VARIANCE FOR JERRY UZZELL FOR "LYNNETTE MARIE ADDITION" 82042 ) WHEREAS, Jerry Uzzell has requested approval of a Preliminary Plat and Variance for a 2.0 acre site for three single family residential lots located in the southeast corner of 26th Avenue North and West Medicine Lake Drive; and, WHEREAS, the Planning Commission has considered the request following a duly called Public Hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a preliminary plat for Jerry Uzzell for three single family residential lots located in the southeast corner of 26th Avenue North and West Medicine Lake Drive, subject to the following conditions: '>. Compliance with the City Engineer's Memorandum, except Item No. 22A, to permit private drive access. 2. Removal. of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until municipal sewer and water are physically available to the site. 4. Compliance with the Park Dedication Policy in effect at the time of filing Final Plat; an outlot shall be provided for the trail corridor. 5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to or contain- ing any open storm water drainage facility. 6. No Building Permits shall be issued unt+1 the Final Plat is filed and recorded with Hennepin County. 7. No yard setbacks are granted or implied. 8. Removal of existing structures at the devei wer's expense. Page two Resolution No. 82-467 9. The private drive accesses to West Medicine Lake Road be consolidated into one shared drive for the three lots. Appropriate legal documents approved by the City Attorney shall be filed with the Final Plat establishinq the shared drive, and providing perpetual maintenance of private drives and utility lines. 10. Approval of variances as to lot width and frontage onto a public road. 11. Private access to Medicine Lake shall be limited to the three properties on this plat; and appropriate legal restrictions approved by the City Attorney shall be Filed with the Final Plat. The motion for adoption of the foregoing Resolution was duly seconded by Copncilmemb_er Neils , and upon vote being taken therrn following voted in favor thereof: Mayor Davenport, Councilmembers oe'ntl, eils, Schneider and Threinen The following voted against or abstained: none ■hereupon the Resolution was declared duly passed and adoptW.
