Pursuant to due call and notice thereof, a CAUi1jar meeting of the City Council of

rnunrilmember Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 82-449
RESOLUTION RELEASING APPROXIMATELY ELEVEN ACRES COMMONLY REFERRED TO
AS THE "NATURAL AREA" FROM THE MAY 23, 1980 LEASE AGREEMENT FOR PLAYFIELD
FACILITIES AT OAKWOOD ELEMENTARY SCHOOL
WHEREAS, The City of Plymouth and Independent School District 284 have entered into a
lease agreement dated May 23, 1980 for the lease of land for park and recreation
plavfield facilities; and
WHEREAS, the northerly 11 acres of the land currently under lease commonly referred
to as the "natural area" is not currently in use nor anticipated for use or playfield
improvements; and
WHEREAS, the Independent School District 284 School Board desires to construct a
maintenance and storage facility on the northwesterly portion of the wildlife area
site; and
WHEREAS, the City Council under Resolution No. 82-376 has approved the site plan and
conditional use permit for the maintenance and storage facility subject to certain
conditions;
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Plymouth,
Minnesota, that it should and hereby does authorize the release of the northerly 11
acres commonly referred to as the "natural area" as shown on the attachad Exhibit H
dated August 12, 1982; and
FURTHER, that said release shall be subject to all terms and conditions as stated in
Resolution No. 82-376, Approving the Site Plan and Conditional Use Permit for the
Storage and Maintenance Facility, specifically Condition No. 9 requirinq a perpetual
restrictive covenant providing that the easterly portion of the undeveloped natural
area (approximately six acres) be preserved; and
FURTHER, requiring the continual unencumbered use of the existing trail running
through the nature center property and intersecting with trails on 19th Avenue North
and Oakwood Playfieid; and
FURTHER, that the City Manager is authorized to communicate the substitution of a
revised Exhibit B dated August 12, 1982 for incorporation in the May 23, 1980 Oakwood
Playfield Lease Agreement in place of the existing Exhibit B dated May 23, 1980.
The motion for adoption of the foregoing Resolution was duly seconded by
