HomeMy WebLinkAboutCity Council Resolution 1982-413CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held Un the 16th day of August . 1982 The following members were present: Acting Mayor c ne7 er, Coun n, — The o lowing members were absent: Mayor Dayenpor fff fft introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-413 EXPRESSING SENSE OF THE COUNCIL REGARDING SUBDIVISION PROPOSAL BY ANNA ROGGEMANN AND DIRECTING PLATTING OF LAND AT 10610 - 36TH AVENUE NORTH (81066) WHEREAS, Anna Roggemann, 10610 - 36th Avenue North, has requested variances from the City's Subdivision Code relative to the proposed division of unplatted property within the City of Plymouth; and, WHEREAS, the Planning Commission considered the request at the January 27, 1982 meeting at the July 28, 1982 meeting at which time approval was recommended subject to a number of conditions; and, WHEREAS, the Planning Commission recommendation endorsed the proposed land division and related variances except for the request to divide the land by metes and bounds description, where the Commission recommended that the land division be accomplished by platting; and, WHEREAS, the City Council considered the request and the Planning Commission recommendation and discussed the matter with the petitioner and her representative; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does express the sense of the Council that the request by Anna Roggemann for variances and for division of unplatted property can he supported in accordance with the July 28, 1982 Planning Commission recommendation subject to the following: 1. The proposed land division shall be accomplished by plattinq; the required preliminary plat Public Hearing and fin31 plat procedures may be consolidated. 2. Compliance with the City Engineer's Memorandum. 3. No yard setback variances are granted or implied. 4. Payment of Park Dedication fees -in -lieu of dedication prior to filing of final plat in accordance with City Policy in effect at the time of filing. 5. No Building Permit be issued until the Final Plat is filed with Hennepin County. Page two 10 Resolution No. 82- 413 6. Submittal of all necessary utility easements prior to filing Final Plat with Hennepin County. 7. Submission to City Attorney for approval recordable documents to establish the shared use of the driveway access to 36th Avenue North for Parcels R and C. 8. Approval of lot width variances for Parcels A and B to allow 85 foot wide lot frontage. 9. Waive the curb cut policy to allow the proposed drives onto 36th Avenue North (Item 12-A of the Engineer's Memorandum); directing that the drive to Parcel .A is to be located at the westerly side. The motion for adoption of the foregoing Resolution was duly seconded by �ouncilmember Neils , and upon vote being taken t reon, the following voted In favor thereof: Acting Playor Schneider, Councilmembers Moen, tow.wand Thrpinen Tine 3�o ng votea aga nst or abstained: none Whereupon the Resolution was declared duly passed and adopted. 0
