HomeMy WebLinkAboutCity Council Resolution 1982-412CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 16th day of August . 1982. The following members were present: Acting Mayor Schneider, Counci mem ers Moen, - -Wpa.a r aril Thro7 ��^ 111@ 1OIlOO memtleUs were absent: none *+fa� sem* Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 82-412 APPROVING CONDITIONAL USE PERMIT AND SITE PLAN FOR DR. ROBERT HOOVER FOR CHURCH OF THE EPIPHANY LOCATED AT THE SOUTHEAST CORNER OF NATHAN LANE AND HAMEL ROAD (82036) WHEREAS, Dr. Robert Hoover for Church of the Epiphany has requested approval of a Conditional Use Permit and Site Plan for "Drakeland Business and Technical Center" located at the southeast corner of Nathan Lane and Hamel Road; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends its approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Dr. Robert Hoover for Church of the Epiphany for a Conditional Use Permit and Site Plan for "Drakeland Business and Technical Center" located at the southeast corner of Nathan Lane and Hamel Road subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Payment of park dedication Fees -in -lieu of dedication in accordance with Dedication Policy in effect at the time of filinq the Final Plat. 3. Compliance with Policy Resolution No. 79-80 reqardinq minimum floor elevations for new structures on sites adjacent to or cont.aininq any open storm water drainage facility. 4. Submission of required financial quarantee for completion of site improvements. 5. Any signage shall be in compliance with the Ordinance. 6. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 7. All waste and waste containers shall be stored within the enclosure identified on staff dated and stamped approved plans. Page two Resolution No. 82-412 8. The property shall be replatted and the Final Plat shall be filed and recorded prior to Issuance of Building Permits. 9. Approval of deferred parking plan. Additional stalls shall be Installed should it become apparent that the Ordinance required number of stalls are needed. 10. The entire access to Hamel Road shall be installed as part of the site improvements. 11. Appropriate legal documents shall be filed establishinq the use of the shared access onto Hamel Road. 12. A revised landscape plan shall be submitted as part of the Final Plat application which provides a comparable plan to the existing commercial uses in the area; the plan shall specifically address the Ordinance scre- ening requirements and transition to the adjacent residential area. 13. Fire lane signage per the Fire Marshal's recommendation shall be completed prior to Certificate of Occupancy. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Moen , and upon vote being taken thereon, the following voted in favor thereof: Actinq Mayor Schneider, Councilmembers Moen, Neils the following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
