Pursuant to due call and notice thereof, a regular meetino of
the City Council of the City of Plymouth, Minnesota was held on the
2nd day of August . 19_a_. The following members were
presentMayor Davenport, Councilmembers Moen. Neils. Schneider and Threinen
The following members were absent: - nont.
Councilmember Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 82-395
REQUEST FOR PAYMENT NO. 3 AND FINAL
EAST MEDICINE LAKE PARK - SITE IMPROVEMENTS
PROJECT NO. 109
WHEREAS, the City of Plymouth as owner and U.D. Contracting, Inc. as contractor
have entered into an agreement for the East Medicine Lake Park Improvements, said
agreement being dated September 16, 1981; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH:
1. That the original contract amount was $122,434.99, one change
order in the amount of $450.00 was approved, and the value of
the work to date is $128,870.33.
2. That the work performed by the contractor for Project No. 109,
site improvements, and certified to the Council by the engineer
as acceptable be and the same is hereby released from the contract
except as to the conditions of the performance bond, any and all
legal rights of the owner, required guarantees and corrections of
faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $33,762.90
to U.D. Contracting, Inc. for Project 109, site improvements, is
hereby approved and the City Finance Director is hereby authorized
and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Threinen , and upon vote being taken thereon, the
following voted in favor there -of: Mayor Davenport, Councilmembers Moen,
Neils Schnieder and Threinen

Whereupon the Resolution was declared duly passed and adopted.
