Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the Znd day of August . 1982.

CoWncil m er Neils introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 82-380
SETTING CONDITIONS TO BE MET PRIOR TO FILING AND REGARDING LOT DIVISION FOR HELEN
RUSTEN (82030)
WHEREAS, the City Council has approved a Lot Division of unplatted property for Helen
Rusten; and,
WHEREAS, the Planning Commission has reviewed the request and has recommended approval;
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the following conditions to be met
prior to filing and regarding the property division with Hennepin County:
1. Compliance with the City Engineer's Memorandum, credit for easements
required by Condition No. 6 of the Engineer's Memorandum shall be
calculated and credited per City Policy and the petitioner shall be
furnished with a copy of the adjustment.
2. No yard setback variances are granted or implied.
3. Compliance with Policy Resolution No. 79-80 regarding minimum floor
elevations for new structures on sites adjacent to or containing open
storm water drainage facilities.
4. Payment of park dedication fees -in -lieu of dedication for the new parcel
prior to issuance of Building Permit in accordance with City Policy in
effect at the time of Building Permit issuance.
5. No Building Permit to be issued until the Lot Division is filed with
Hennepin County.
6. Prior to issuance of Building Permits on the new parcel a future Sub-
division Plan shall be submitted by the owner for review and approval
by the City.

7. Submittal of all necessary utility easements prior to filing Lot Division
with Hennepin County.
8. Approved variances include those as requested regarding division other than
by platting, and frontage on a public street in consideration of the minimal
impact on other properties and the external effects on the petitioner's land
which have occurred over time that were not caused by the petitioner. The
variance request satisfies the Subdivision Code criteria for granting
variances.
The motion for adoption of the foregoing Resolution was duly seconded by
